Wearing Niqaab

Q: Can a muslim sister at the age of 45 suddenly decide she wants to wear niqab for her remaining years? During all her past years, she wore hijab exposing her face and wrists. What are the prerequisites and stipulations to be adhered to when in purdah? She comes from a very humble home with no car, hence she uses public transport. She has no other option but to do errands like shopping for food by herself. Is that permissible? She is a devout muslim but postponed purdah because of these reasons where she must walk on public roads to take and fetch her child from school. Whenever in public, she feels very vulnerable and guilty. She always considered wearing the purdah but was influenced not to.

A: In Islam, it is compulsory upon women to wear the niqaab. Therefore, the sister should be encouraged to start wearing the niqaab for the remaining years of her life. She should repent to Allah Ta’ala for not wearing the niqaab for the past years. Allah Ta’ala is most forgiving and all merciful. 

Women are commanded to remain within the confines of their homes. Unless there is a valid need, they should not leave their homes. As far as purchasing the groceries, shopping and fetching the children from school are concerned, then these responsibilities and duties rest on the shoulders of the husband or any other family member e.g. father, brother etc. If the woman does not have a husband and there is nobody else willing to assist her, then she can leave her home to fulfill the necessary duties and responsibilities. However, she should limit her leaving the home to the point of need. Similarly, she should ensure that the laws of hayaa and modesty are maintained (i.e. she should dress in an unattractive manner, not applying perfume, wearing the niqaab and not intermingle with non-mahrams). 

وَقَرْنَ فِي بُيُوتِكُنَّ وَلَا تَبَرَّجْنَ تَبَرُّجَ الْجَاهِلِيَّةِ الْأُولَى وَأَقِمْنَ الصَّلَاةَ وَآتِينَ الزَّكَاةَ وَأَطِعْنَ اللَّـهَ وَرَسُولَهُ إِنَّمَا يُرِيدُ اللَّـهُ لِيُذْهِبَ عَنكُمُ الرِّجْسَ أَهْلَ الْبَيْتِ وَيُطَهِّرَكُمْ تَطْهِيرًا   (سورة الاحزاب آية 33)

عن أبى هريرة قال لقيته امرأة وجد منها ريح الطيب ينفح ولذيلها إعصار فقال يا أمة الجبار جئت من المسجد قالت نعم. قال وله تطيبت قالت نعم. قال إنى سمعت حبى أبا القاسم صلى الله عليه وسلم- يقول لا تقبل صلاة لامرأة تطيبت لهذا المسجد حتى ترجع فتغتسل غسلها من الجنابة (سنن أبي داود، الرقم: 4174)

وحيث أبحنا لها الخروج فإنما يباح بشرط عدم الزينة وتغير الهيئة إلى ما يكون داعية لنظر الرجال والاستمالة قال الله تعالى ولا تبرجن تبرج الجاهلية الأولى (رد المحتار 3/604)

لا تركب مسلمة على سرج الحديث هذا لو للتلهي ولو لحاجة غزو أو حج أو مقصد ديني أو دنيوي لا بد لها منه فلا بأس به (الدر المختار 6/423)

 قال العلامة ابن عابدين - رحمه الله -: قوله ( للحديث ) وهو لعن الله الفروج على السروج ذخيرة لكن نقل المدني عن أبي الطيب أنه لا أصل له اه يعني بهذا اللفظ وإلا فمعناه ثابت ففي البخاري وغيره لعن رسول الله المتشبهين من الرجال بالنساء والمتشبهات من النساء بالرجال وللطبراني أن امرأة مرت على رسول الله متقلدة قوسا فقال لعن الله المتشبهات من النساء بالرجال والمتشبهين من الرجال بالنساء قوله ( ولو لحاجة غزو إلخ ) أي بشرط أن تكون متسترة وأن تكون مع زوج أو محرم قوله ( أو مقصد ديني ) كسفر لصلة رحم ط (رد المحتار 6/423)

فروع استأجر امرأته لتخبز له خبزا للأكل لم يجز قال الشامي: قوله ( لم يجز ) لأن هذا العمل من الواجب عليها ديانة لأن النبي قسم الأعمال بين فاطمة وعلي فجعل عمل الداخل على فاطمة وعمل الخارج على علي (رد المحتار 6/62)
