Water that is recycled from sewerage

Q: What is the status of water that is recycled from sewerage?

A: According to the terminology of fiqh, though such recycled water cannot be regarded as napaak (impure) (as it undergoes a chemical purifying process passing through three chambers and thereafter being poured without any traces of impurity into a lake or dam) however it is not something that one would desire consuming. We all understand that everything that is regarded paak is not consumed. Consider the mucus in one's nose, if it has to fall into a glass of water, despite it not being napaak, one would not wish to consume it. Similar is the case of recycled sewerage water. The government should consider other purifying schemes and methods in providing clean water to the public without compromising the standards of hygiene and cleanliness. In other countries such as India, Hong Kong, Cyprus, United States, United Kingdom, etc. water is desalinated through the process of reverse osmosis whereby the salt content is removed from sea water and thereafter made available to the public for consumption. Alternatively structures could be put up to gather and collect the rain water and channel it towards the rivers and dams. In this way there would be no need to recycle the sewerage water. وفي النصاب والفتوى في الماء الجاري أنه لا يتنجس ما لم يتغير طعمه أو لونه أو ريحه من النجاسة كذا في المضمرات وإذا ألقي في الماء الجاري شيء نجس كالجيفة والخمر لا يتنجس ما لم يتغير لونه أو طعمه أو ريحه كذا في منية المصلي (الفتاوى الهندية 1/17)

وحاصله أن الماء الجاري وما هو في حكمه إذا وقعت فيه نجاسة إن ظهر أثرها لا يجوز الوضوء به وإلا جاز لأن وجود الأثر دليل وجود النجاسة فكل ما تيقنا فيه نجاسة أو غلب على ظننا ذلك لا يجوز الوضوء به جاريا كان أو غيره لأن الماء الجاري لا يتنجس بوقوع النجاسة فيه كما قد يتوهم وظاهر ما في المتون أن الجاري إذا وقعت فيه نجاسة يجوز الوضوء به إن لم ير أثرها سواء كان النجس جيفة مرئية أو غيرها فإذا بال إنسان فيه فتوضأ آخر من أسفله جاز ما لم يظهر في الجرية أثره (البحر الرائق 1/88)

وأما بيان المقدار الذي يصير به المحل نجسا شرعا: فالنجس لا يخلو إما أن يقع في المائعات كالماء والخل ونحوهما وإما أن يصيب الثوب والبدن ومكان الصلاة فإن وقع في الماء فإن كان جاريا فإن كان النجس غير مرئي كالبول والخمر ونحوهما لا ينجس ما لم يتغير لونه أو طعمه أو ريحه ويتوضأ منه من أي موضع كان من الجانب الذي وقع فيه النجس أو من جانب آخر (بدائع الصنائع 1/77)
