Selling a mobile phone which has musical ringtones from the factory
Q: I wanted to sell my old mobile phone, but it has musical ringtones on it which have been there from the beginning as factory settings and can’t be deleted. Can I sell the phone in spite of that? What about selling it to non-Muslims, even though they might do haraam with the phone?
A: The principle of Shari’ah is that it is impermissible for one to sell an item that can only be used for a haraam purpose. As for an item that has a dual or multiple purpose where it can be used for haraam as well as halaal e.g. a cellphone, selling it will be permissible. However, if one has knowledge that the person purchasing the item is purchasing it for a haraam purpose, then in that case, selling the item to him will be impermissible. If you are not aware of the purpose for which the person is purchasing it, it will be permissible for you to sell it to him.

جواز البيع يدور مع حل الانتفاع وحرمة الانتفاع بها (مجمع الأنهر 2/108)
(قوله مالا أو لا إلخ) المراد بالمال ما يميل إليه الطبع ويمكن ادخاره لوقت الحاجة والمالية تثبت بتمول الناس كافة أو بعضهم والتقوم يثبت بها وبإباحة الانتفاع به شرعا فما يباح بلا تمول لا يكون مالا كحبة حنطة وما يتمول بلا إباحة انتفاع لا يكون متقوما كالخمر وإذا عدم الأمران لم يثبت واحد منهما كالدم بحر ملخصا عن الكشف الكبير (رد المحتار 4/501)
وإذا كان أحد العوضين أو كلاهما محرما فالبيع فاسد كالبيع بالميتة والدم والخنزير والخمر (الهداية 3/49)
