Performing salaah behind a Masbooq

Q: What is the ruling regarding one who misses the jamaat and joins a masbooq while he is performing his missed rakaats? Will the salaah of such a person be valid? Similarly, can one perform his fardh salaah behind a person who is performing his sunnat or nafl salaah?

A: It is not permissible for one to perform salaah behind a masbooq (one who stands up to complete his missed rakaats after the Imaam makes salaam). Similarly, it is not permissible for one to perform his Fardh Salaah behind the one who is performing his sunnats or nafl salaah. In both cases, the Salaah of the person performing his fardh will not be valid and will have to be repeated.

( وشروط صحة الاقتداء أربعة عشر شيئا ) تقريبا ... ( وأن لا يكون ) الإمام ( أدنى حالا من المأموم ) كأن يكون متنفلا والمقتدي مفترضا ... ( ولا مسبوقا ) لشبهة اقتدائه
و في حاشية الطحطاوي : قوله ( لشبهة إقتدائه ) أي حال تحريمته وإنما لزمته القراءة لشبهة الإنفراد (حاشية الطحطاوي على مراقي الفلاح ص290)
