Selling unclaimed goods which were left for repairs

Q: What should I do if someone has left their computer with me for repairs, and after telling them that it can’t be repaired or it needs a certain part, they just leave it with me and don’t come back? After contacting such people, they don’t come to collect their computers and eventually there is no contact with them. What should I do with such computers?

A: You can sell them and keep the cash as an amaanah (trust). If the person comes later on, return the cash to him. If he does not come back then you should give the cash in sadaqah to some poor person.

قال أصحابنا رحمهم الله تعالى للبائع حق حبس المبيع لاستيفاء الثمن إذا كان حالا كذا في المحيط... والمشتري إذا نقد الثمن كله أو أبرأه البائع عن كله بطل حق الحبس كذا في البدائع (الفتاوى الهندية 3/15-16)

فأما (النوع الثاني) وهو ما يعلم أن صاحبه يطلبه فمن يرفعه فعليه أن يحفظه ويعرفه ليوصله إلى صاحبه وبدأ الكتاب به ورواه عن إبراهيم قال في اللقطة يعرفها حولا فإن جاء صاحبها وإلا تصدق بها (المبسوط للسرخسي 11/3)
