Who's responsible for the funeral expenses
Q: Please tell me the steps in sequence of those responsible for the funeral expenses in the case where the mayyit cannot afford it?
A: In the case where the mayyit does not leave anything behind or the amount the mayyit leaves behind is insufficient for fulfilling the burial expenses, the burial expenses will be borne by the heirs of the deceased.
وإن لم يكن له من تجب عليه نفقته فكفنه في بيت المال فإن لم يكن فعلى المسلمين تكفينه فإن عجزوا سألوا الناس كذا في الزاهدي وفي العتابية وإن لم يوجد ذلك غسل وجعل عليه الإذخر ودفن ويصلى على قبره كذا في التتارخانية رجل مات في مسجد قوم فقام أحدهم وجمع الدراهم ففضل من ذلك شيء إن عرف صاحب الفضل رده عليه وإن لم يعرف كفن به محتاجا آخر وإن لم يقدر على صرفه إلى الكفن يتصدق به على الفقراء كذا في فتاوى قاضي خان (الفتاوى الهندية 1/161)
