Mistakenly standing up for the third rakaat in a two rakaat salaah

Q: If while praying two rakaats salaah, after sujood of the two rakaats, one forgets he has completed one or two rakaats and therefore stands up with the intention of praying one more rakaat and doing sajda sahaw but on standing he remembers accuratley that he in fact has completed two rakaats.

1. In this situation, while he has stood up with or has already started reciting Surah Fatiha, is it permissible to go to tashahhud or one should complete four rakaats?

2. Would sajdah sahaw be needed after completing four rakkats?

3. Or salah will not be valid and one must repeat it, if for example he was praying two rakaat sunnat muakkadah of Fajr or two rakaats Fardh of Fajr because he has prayed four rakkats instead of two?

A: If one is performing a two rakaat salaah (e.g. the fard of fajr) and mistakenly stood up for the third rakaat, then he should immediately return to the sitting position and complete the salaah with sajdah e sahw. If he forgets to make the sajdah e sahw at the end of the salaah, he will have to repeat the salaah as long as the salaah time remains.

In the above situation, if he did not sit after two rakaats and stood up for the third rakaat and thereafter completed four rakaats, regardless of whether he made sajdah e sahw at the end of the salaah or not, the salaah will have to be repeated.

The reason one will have to repeat the fard salaah is that one did not sit for qadah after two rakaats. The qadah after the two rakaats is fard (in a two rakaat salaah) and when one had left out this fard, the salaah became nafil and one will have to repeat the fard.

However, if one had sat after two rakaats and thereafter mistakenly stood up and completed four rakaats, then in this case since one had sat for qadah , the salaah will be valid but one will have to make sajdah e sahw at the end of the salaah.

Q:He will have to repeat the salaah as long as the salaah time remains”. Does it mean, if salaah time has passed, the salaah will not have to be repeated even if it was a fardh salaah?

A: Yes. In the case where one had sat for the last qadah before standing up, one will not have to repeat the salaah after the time passes.
