Taking a shorter or longer route when travelling
Q: If a person sets out on a journey to a certain place. There are two different routes that he can take to reach his destination. The first route is less than 78km while the second route is more than 78km. Will such a person be considered a musaafir if he takes any of the two routes when travelling to his destination?
A: It will depend on the route he takes. If he takes the shorter route, he will not be a musaafir and if he takes the longer route, he will be a musaafir.

وتعتبر المدة من أي طريق أخذ فيه، كذا في البحر الرائق فإذا قصد بلدة وإلى مقصده طريقان أحدهما مسيرة ثلاثة أيام ولياليها والآخر دونها فسلك الطريق الأبعد كان مسافرا عندنا، هكذا في فتاوى قاضي خان، وإن سلك الأقصر يتم، كذا في البحر الرائق (الفتاوى الهندية 1/138)
وفي فتاوى قاضي خان أن الرجل إذا قصد بلده وإلى مقصده طريقان: أحدهما مسيرة ثلاثة أيام ولياليها، والآخر دونها فسلك الطريق الأبعد كان مسافرا عندنا اهـ. وإن سلك الأقصر يتم (البحر الرائق 2/140)
