Selling an item before paying for it in full
Q: I purchased an item for R10 000. However, I have only paid R1 000 so far, and the rest of the R9 000 will be paid later within a set time period. When I have not paid fully for the item, can I sell it to someone else?
A: Since you have purchased the item, you are the owner of it, even though you have not yet paid for it in full. Hence, when you are the owner of the item, you may deal in it as you please. If you wish to sell it, it is also permissible for you to do so.

وأما حكمه فثبوت الملك في المبيع للمشتري وفي الثمن للبائع إذا كان البيع باتا (الفتاوى الهندية 3/3)
وأما حكم البيع فهو ثبوت الملك في المبيع للمشتري وثبوت الملك في الثمن للبائع إذا كان البيع باتا من غير خيار (تحفة الفقهاء 2/37)
(وإذا حصل الإيجاب والقبول) يعني عن الأصل مضافا إلى المحل مع شرط النفاذ وهو الملك أو الولاية (لزم البيع ولا خيار لواحد منهما) أي لأحد المتعاقدين (البناية 8/11)
