Distributing an estate according to an unislamic will

Q: A lady passed away a few weeks ago and left behind a will which was not an Islamic will.

1. What will be the consequences to the deceased if her estate will be distributed according to the will she left behind?

2. Who would be responsible to ensure that the estate will be distributed Islamically? If the heirs decide to go ahead with the distribution according to the CURRENT will, what will be the consequences?

A:

1. Both the heirs and the deceased will be sinful.

2. All the heirs and surviving family should try their best to ensure that it is corrected. If they do not, then the wealth that they consume will be haraam, and consuming haraam has got its own consequences of difficulties and disaster.

And Allah Ta'ala (الله تعالى) knows best.

(وشرائطها كون الموصي أهلا للتمليك) ... (وعدم استغراقه بالدين) ... (و) كون (الموصى له حيا وقتها) ... (و) كونه (غير وارث) وقت الموت (ولا قاتل) وهل يشترط كونه معلوما. قلت: نعم كما ذكره ابن سلطان وغيره في الباب الآتي (و) كون (الموصى به قابلا للتملك بعد موت الموصي) بعقد من العقود مالا أو نفعا موجودا للحال أم معدوما وأن يكون بمقدار الثلث

قال العلامة ابن عابدين – رحمه الله-: (قوله: وأن يكون بمقدار الثلث) أي إن كان ثمة وارث ولم يجزها بالأكثر وبما قررناه ظهر أن هذه الشروط بعضها شروط لزوم وهي ما توقفت لحق الغير ونفذت بإجازته وبعضها شروط صحة (رد المحتار 6/651)

(وتجوز بالثلث للأجنبي) عند عدم المانع (وإن لم يجز الوارث ذلك لا الزيادة عليه إلا أن تجيز ورثته بعد موته) ولا تعتبر إجازتهم حال حياته أصلا بل بعد وفاته (وهم كبار) يعني يعتبر كونه وارثه أو غير وارث وقت الموت لا وقت الوصية على العكس إقرار المريض للوارث (رد المحتار 6/652)
