Mandatory Insurance Claims

Q: My friend was going from Torino to Rome in a car with his friends (my friend was not the car owner). Another person crashed his car into the car which my friend was travelling in. In Italy, it is mandatory for every car to have insurance. In the case of an accident, anyone who was in the car and was injured, whether the owner or just a passenger, will be paid some money, depending on the extent of their injury. My friend was injured in this accident and his collar bone was broken. Regarding this situation, we want to ask the following questions:

1. Insurance can be claimed for all the people involved in the accident. The amount is paid by the insurance companies and not by the individuals who are responsible for the accident. We had not applied for any insurance for this purpose, but there is a rule here that we can claim for it from the company through which the car was insured. Is it permissible for us to place a claim for this kind of compensation (insurance money)?

2. If it is permissible for us to place a claim, can we use this amount for our own purposes? If not, can we donate it to poor people or some madrasah, etc.? If we can donate it, should we make the intention of thawaab or not?

3. If we can apply for the insurance payout, then a lawyer will file our case to claim the insurance money. If we receive the payout, can we pay the lawyer from the insurance money or do we have to pay his fees from our own pocket?

A: 1) In a country where insuring the vehicle is compulsory from the side of the government, it will be permissible for one to insure his vehicle as well as receive the amount paid out by the insurance company. However, when claiming, it will only be permissible for one to take back the amount that he had paid to the insurance company in his monthly premiums.

2) Since the money is in lieu of the damages caused, it will be permissible for one to claim it. On receiving the money, one can use it as one pleases. Hence, it can be donated to the poor or given to a madrasah with the intention of receiving thawaab.

3) It is permissible to pay the lawyer from the money received from the insurance company.

السادسة الحاجة تنزل منزلة الضرورة عامة كانت أو خاصة ولهذا جوزت الإجارة على خلاف القياس للحاجة ولذا قلنا لا تجوز إجارة بيت بمنافع بيت لاتحاد جنس المنفعة فلا حاجة بخلاف ما إذا اختلف ومنها ضمان الدرك جوز على خلاف القياس ومن ذلك جواز السلم على خلاف القياس لكونه بيع المعدوم دفعا لحاجة المفاليس ومنها جواز الاستصناع للحاجة ودخول الحمام مع جهالة مكثه فيها وما يستعمله من مائها وشربة السقاء (الأشباه والنظائر 1/ 267)

وفي التاترخانية عن التتمة سألت أبا يوسف رحمه الله تعالى عن الرجل يدخل السفينة أو يحتجم أو يفتصد أو يدخل الحمام أو يشرب الماء من السقاء ثم يدفع الأجرة وثمن الماء قال يجوز استحسانا ولا يحتاج إلى العقد قبل ذلك اهـ قلت ومنه ما قدمناه عنها من انعقادها بغير لفظ وسيأتي في المتفرقات عن الأشباه السكوت في الإجارة رضا وقبول وفي حاوي الزاهدي رامزا استأجر من القيم دارا وسكن فيما ثم بقي ساكنا في السنة الثانية بغير عقد وأخذ القيم شيئا من الأجرة فإنه ينعقد به في كل السنة لا في حصة ما أخذ فقط اهـ ومثله في القنية في باب انقضاء الإجارة بعد انقضاء مدتها ووجوب الأجر بغير عقد حامدية (رد المحتار 6/ 6)

والباطل لا يفيد ملك التصرف (وملك الرقبة) ولو هلك المبيع في يد المشتري فيه يكون أمانة عند بعض المشايخ لأن العقد غير معتبر فبقي القبض بإذن المالك وعند البعض يكون مضمونا لأنه لا يكون أدنى حالا من المقبوض على سوم الشراء وقيل الأول قول أبي حنيفة رحمه الله والثاني قولهما كما في بيع أم الولد والمدبر على ما نبينه إن شاء الله تعالى والفاسد يفيد الملك عند اتصال القبض به ويكون المبيع مضمونا في يد المشتري فيه (الهداية 3/43)

(كل عقد جاز أن يعقده الإنسان بنفسه جاز أن يوكل به غيره) لأن الإنسان قد يعجز عن المباشرة بنفسه على اعتبار بعض الأحوال فيحتاج إلى أن يوكل غيره فيكون بسبيل منه دفعا للحاجة (الهداية 3/136)
