Women applying for divorce
Q: A woman whose husband leaves her for 1 year 8 months with no contact and applies for a legal divorce and signs documents for separation and the magistrate dissolves their marriage in the family court. Now its 4 months from the divorce date. Can the woman make nikah again?
A: A woman does not have the authority to divorce and if she is in some severe constraints she may apply to an Islamic court or council of ulama. They will listen to both sides and thereafter they will pass a judgement.

عن سليمان بن يسار قال الطلاق بالرجال والعدة بالنساء (مصنف لابن أبي شيبة رقم 18558)
( والتفريق ) بينهما ( طلاق ) ينقص العدد ( لو أبى لا لو أبت ) لأن الطلاق لا يكون من النساء
قال الشامي في رد المحتار : قوله ( لأن الطلاق لا يكون من النساء ) بل الذي يكون من المرأة عند القدرة على الفرقة شرعا هو الفسخ فينوب القاضي منابها فيما تملكه (رد المحتار 3/ 189)
