Who will be the Wali?
Q: We had an affair and had an illegitimate daughter from that affair. After that we got married. Now my daughter is 20 years old. She does not know anything about this and she is going to marry soon. My question is can I be the Wali (guardian) to my daughter? If not who can be the Wali?
A: If the child was born six months or more after the nikaah, the child will be regarded as your child and hence you will be the wali.
وإذا تزوج الرجل امرأة فجاءت بولد لأقل من ستة أشهر منذ يوم تزوجها لم يثبت نسبه لأن العلوق سابق على النكاح فلا يكون منه وإن جاءت به لستة أشهر فصاعدا يثبت نسبه اعترف به الزوج أو سكت (الهداية 2/432)
وفي مجموع النوازل إذا تزوج امرأة قد زنى هو بها وظهر بها حبل فالنكاح جائز عند الكل وله أن يطأها عند الكل وتستحق النفقة عند الكل كذا في الذخيرة (الفتاوى الهندية 1/280)
