Extended warranty on a cellphone

Q: I am purchasing a cellphone and have been offered the following option for extending the warranty:

Pay $10 a month and if you lose or break your phone, you can get a new one. Plus, every six months, you can trade in your old phone, pay the difference and get a new one.

A: This is not permissible. It comes under the ambit of the Islamic definition of gambling.

عن أبي هريرة رضي الله عنه أن النبي صلى الله عليه وسلم نهى عن بيع الغرر (سنن أبي داود، الرقم: 3376)

البيوع الفاسدة أنواع... ومنها أن يكون في المبيع أو في ثمنه غرر مثل بيع السمك في الماء وهو لا يقدر على تسليمه بدون الاصطياد والحيلة وبيع الطير في الهواء أو بيع مال الغير على أن يشتريه فيسلمه إليه لأنه باع ما ليس بمملوك له للحال وفي ثبوته غرر وخطر (تحفة الفقهاء 2/48)
