Husband empowering his wife with the right of talaaq

Q: Three years ago I told my wife I want a talaaq, I want a talaaq, I want a talak 3 times and she replied yes all 3 times. Is the talaaq valid? Reasons for the talaaq was that she comitted Zina.

A: Talaaq is the sole right of the husband. Hence if the husband issues the talaaq, the talaaq will fall. Regardless of whether the wife consents to the talaaq or not. However if the husband empowers his wife with the right of issuing the talaaq, then by the wife issuing the talaaq, the talaaq will take place. In the case in question, if the husband, by saying "I want a talaaq" meant that he is asking his wife to issue the talaaq after giving her the right to do so, and she said "yes", then the talaaq will take place.

وإذا قال لامرأته اختاري ينوي بذلك الطلاق أو قال لها طلقي نفسك فلها أن تطلق نفسها ما دامت في مجلسها ذلك فإن قامت منه أو أخذت في عمل آخر خرج الأمر من يدها لأن المخيرة لها المجلس بإجماع الصحابة رضي الله عنهم أجمعين ولأنه تمليك الفعل منها والتمليكات تقتضي جوابا في المجلس كما في البيع لأن ساعات المجلس اعتبرت ساعة واحدة إلا أن المجلس تارة يتبدل بالذهاب عنه وتارة بالاشتغال بعمل آخر إذ مجلس الأكل غير مجلس المناظرة ومجلس القتال غيرهما (الهداية 2/376)

( والتفريق ) بينهما ( طلاق ) ينقص العدد ( لو أبى لا لو أبت ) لأن الطلاق لا يكون من النساء

قال الشامي في رد المحتار : قوله ( لأن الطلاق لا يكون من النساء ) بل الذي يكون من المرأة عند القدرة على الفرقة شرعا هو الفسخ فينوب القاضي منابها فيما تملكه (رد المحتار 3/190)
