Qadha Salaah

Q: What is the ruling of Qadha salah? Is there any authentic ahadith regarding this? Is Qadha for those who missed salah intentionally or repentance is enough. In India we make up our salah in all cases whether it is intentionally or any other way, if we miss we make the salah. I saw a saying if Ibn  Taimaiyyah : Volume 2, Page 99a: In law, there is no way for one who leaves a salah intentionally to make its qada' 

Working in Ladysmith, living in PMB and staying in Durban in the weekends

Q: I live in PMB. I am currently on audit at Laysmith, and spend Monday to Friday in Ladysmith. I do not go home (PMB) during weekends, but go to a house in Durban. I intend continuing like this for the next month or two. The distance from my home to the Durban house is about 80KM, but from boundary to boundary would probably be less than 77Km. From PMB to Ladysmith is about 170KM.

During the weekends, whilst returning from Ladysmith, I bypass my home in PMB. I sometimes stop here temporarily; to collect items, visit my parents, drop off stuff etc, or even for Namaaz; and then proceed to Durban.

Am I a Musafir in:

  • Durban,
  • Ladysmith, and
  • Pietermaritzburg.

Missing Salaah on a journey

Q: A musafir who is travelling and is not yet at his destination, can he miss his salaah and make it qadhaa?

Q: Is it permissible to hold candlelight vigils/candlelight memorials?

Salaah time expiring while one is performing Salaah

Q: It read if one one makes a niyyah ''to pray the fard of the current time'' and the time ends during the performance of salaah, and one does not know this then the salaah is not sahih. But when one knows the time ended during performance then the salaah is sahih. True? But if one had make niyyah ''to pray the fard of Dhuhr of today'' then salaah is sahih if during performance another prayer time enters. True?

Performing Salaah while people are making a noise at the back

Q: Does the salaah become makruh if during praying people at the backside of the mosque start talking and making noise? In such state is one aloud to commence a salaat?

Missing Salaah on a journey due to requiring ghusal

Q: A traveler who does not have ghusal can he miss his salaah?

Q: If someone misses for example Fajr and he does not make it up until 11 salaats are passed by i.e. he makes it up two days later after Dhuhr.

How much salaats this person has to make up (and is the order waived or not ?) according to the view of Imaam Muhammad and Abu Yusuf? And what according to Abu Hanifa. And what is the fatwa upon ?

I read that according to Abu Hanifa if one does misses for example Fajr but does not makes it up and prays Dhuhr, then the Dhuhr becomes Mawquf (Muwaqqat) Fasad and if he continues praying upto the next days Dhuhr and thereafter makes qada of Fajr then all the salaahs will become Sahih. And if he makes it up before next days Dhuhr all the salaats will become Fasad.

And according to Imaam Muhammad and Abu Yusuf, only the salaats after the 6th one will become Sahih. The ones before will according to Imaam Muhammad be complete Fasad, and according to Abu Yusuf they will become nafila. It's said in a narration Abu Yusuf is with Imaam Muhammad. Is this all correct ?

The Fasad according to Abu Hanifa if one makes it up before next days Dhuhr (as in the example in the initial post) is this complete Fasad or does it turn into nafila?

Qadhaa of the namaaz left out on safar

Q: A musafir if he never read his namaaz on his journey, he still reads qasr at home. If he does not read it qasr but full, is his salaah valid?

Reciting in a way that one can here himself in Salaah

Q: If I move my lips and tongue in my own individual namaaz but not to such an extent that I can hear myself had there to be pin-drop silence, is my salaah valid?
