Q: During the process of winding up my father’s estate, my sister accused one of the other heirs of stealing their father’s money. The said heir was very upset over this accusation. Hence, this heir forfeited their share of the inheritance in the estate.
Few years later, my sister retracted the accusation and apologized. She also stated that if it was due to her that the other heir revoked their share of inheritance, then she is ready to negotiate a way to give back that share of inheritance. This however did not materialise till this day.
Please advise if the forfeiting of the share, under the circumstances concerned, were valid and binding? If yes, who should that share be given to?

A: Many of the Hanafi Fuqaha (jurists) have ruled that in the case where an heir forfeits his/her share of inheritance before receiving it, then this forfeiting will not be considered valid and the heir will still be entitled to receive his/her share. Hence, based on this ruling of the Fuqaha, the heir is still entitled to receive her share, especially when she did not give it wilfully but gave it in the state of anger while being emotionally affected, due to being wrongfully accused of stealing from the estate.
Among these Hanafi Fuqaha are the following:
(1) Allaamah Qaadhikhaan (rahimahullah) (d. 592)
(2) Allaamah Ibnu Qaadhi Samaawnah (rahimahullah) (d. 823)
(3) Allaamah Bazzaaz (rahimahullah) (d. 827)
(4) Allaamah Ibnus Shihnah (rahimahullah) (d. 882)
(5) Allaamah Alaaud Deen Shaami (rahimahullah) (d. 1306)
(6) Moulana Ashraf Ali Thaanwi (rahimahullah) (d. 1362)
(7) Mufti Azeezur Rahmaan (rahimahullah)
(8) Mufti Rasheed Ahmad Ludhyaanwi (rahimahullah) (d. 1422)
(9) Mufti Abdul Haqq (rahimahullah), the author of Fatawaa Haqqaniyah

وفي جامع الفتاوى ولو قال تركت حقي من الميراث أو برئت منه أو من حصتي لا يصح وهو على حقه لأن الإرث جبري لا يصح تركه (لسان الحكام صـ ٢٣٦)
ولو قال تركت حقي من الميراث أو برئت منه أو من حصتي لا يصح وهو على حقه لأنه الإرث جبري لا يصح تركه (الفتاوى البزازية ٦/١٥١)
ولو قال تركت حقي من الميراث أو برئت منها ومن حصتي لا يصح وهو على حقه، لان الارث جبري لا يصح تركه (تكملة رد المحتار 8/208)
قال أحد ورثته برئت من تركة أبي، يبرأ الغرماء عن الدين بقدر حصته ... لو قال وارث تركت حقي، لا يبطل حقه إذ الملك لا يبطل بالترك، والحق يبطل به، حتى أن أحد الغانمين لو قال قبل القسمة: تركت حقی، بطل حقه (جامع الفصولين : ۳۹/۲)
رجل له مسيل ماء في دار غيره فباع صاحب الدار داره مع المسيل ورضي به صاحب المسيل كان لصاحب المسيل أن يضرب بذلك في الثمن وإن كان له حق إجراء الماء دون رقبة النهر لا شيء له من الثمن ولا سبيل له على المسيل بعد ذلك كرجل أوصى لرجل بسكنى داره فمات الموصى فباع الوارث الدار ورضي به الموصى له جاز البيع وبطل سكناه ولو لم يبيع صاحب الدار داره ولكن قال صاحب المسيل أبطلت حقي في المسيل فإن كان له حق إجراء الماء دون الرقبة بطل حقه قياساً على حق السكنى وإن كان له رقبة المسيل لا يبطل ذلك بالإبطال لأن ملك العين لا يبطل بالإبطال (فتاوى قاضيخان 3/109)
