Painting the premises before leaving
Q: I used to work for an organization. The organization used to house all employees in flats or apartments. The rent as well as the levy, water and light bills used to be paid by them. It is stated in the lease contract of the apartment that upon leaving, the tenant should get the place painted. The organization did not mention to me, when I moved in, that I will have to bear the cost of the painting. To me, it was understood that the organization will bear the cost of painting the apartment as they used to bear all other costs. Is the cost of painting my responsibility or the responsibility of the organization?
A: It is the responsibility of the one who hired the premises (i.e. the tenant) to paint the place before he hands it over to the landlord. Hence, if your company hired the flat, the responsibility of painting the place will be upon them. However, if you hired the flat and your company helped you to pay the rent, then the responsibility of painting the place will be upon you.

حدثنا كثير بن عبد الله بن عمرو بن عوف المزني عن أبيه عن جده أن رسول الله صلى الله عليه وسلم قال الصلح جائز بين المسلمين إلا صلحا حرم حلالا أو أحل حراما والمسلمون على شروطهم إلا شرطا حرم حلالا أو أحل حراما. هذا حديث حسن صحيح (سنن الترمذي، الرقم: 1352)
الأصل عندنا أن المستأجر يملك الإجارة فيما لا يتفاوت الناس في الانتفاع به كذا في المحيط... وإذا استأجر دارا وقبضها ثم آجرها فإنه يجوز إن آجرها بمثل ما استأجرها أو أقل وإن آجرها بأكثر مما استأجرها فهي جائزة أيضا إلا إنه إن كانت الأجرة الثانية من جنس الأجرة الأولى فإن الزيادة لا تطيب له ويتصدق بها وإن كانت من خلاف جنسها طابت له الزيادة ولو زاد في الدار زيادة كما لو وتد فيها وتدا أو حفر فيها بئرا أو طينا أو أصلح أبوابها أو شيئا من حوائطها طابت له الزيادة وأما الكنس فإنه لا يكون زيادة وله أن يؤاجرها من شاء إلا الحداد والقصار والطحان وما أشبه ذلك مما يضر بالبناء ويوهنه هكذا في السراج الوهاج ولو آجر مع ما استأجر شيئا من ماله مما يجوز أن يعقد عليه عقد الإجارة طابت له الزيادة هكذا في المحيط (الفتاوى الهندية 4/425)
