Making a second jamaat in the Musjid

Q: Is it permisible to recite iqamah in a second jamaat performed in a masjid, the type of masjid is at a tourist place and has no particular Imam. (Note the earlier jamaat was completed and we reached late and performed the second jamaat in the particular masjid).

A: If the Musjid is a Musjid-e-Shaari' (i,e, a Musjid on the side of the road that does not have a fixed Imaam and the Salaah times are not stipulated, rather people passing by perform their Salaah in the Musjid at the own convenience in their own times and continue) then it will be permissible to make a second jamaat.

And Allah Ta'ala (الله تعالى) knows best.

ويكره تكرار الجماعة بأذان وإقامة في مسجد محلة لا في مسجد طريق أو مسجد لا إمام له ولا مؤذن

قال الشامي : (قوله ويكره) أي تحريما لقول الكافي لا يجوز والمجمع لا يباح وشرح الجامع الصغير إنه بدعة كما في رسالة السندي (قوله بأذان وإقامة إلخ) عبارته في الخزائن أجمع مما هنا ونصها يكره تكرار الجماعة في مسجد محلة بأذان وإقامة إلا إذا صلى بهما فيه أولا غير أهله لو أهله لكن بمخافتة الأذان ولو كرر أهله بدونهما أو كان مسجد طريق جاز إجماعا كما في مسجد ليس له إمام ولا مؤذن ويصلي الناس فيه فوجا فوجا فإن الأفضل أن يصلي كل فريق بأذان وإقامة على حدة كما في أمالي قاضي خان اهـ ونحوه في الدرر والمراد بمسجد المحلة ما له إمام وجماعة معلومون كما في الدرر وغيرها (رد المختار 1/ 552)
