Making a second jamaat in the Musjid
Q: If a group of people, who are not musaafirs, come late to the musjid after the first Jamaat is over, will it be better for each person to perform his Salaah individually or for them to make a second jamaat? Will the same ruling apply if they perform their Salaah in the sehn of the musjid? (i.e. will it be better for each person to perform his Salaah individually or for them to make a second jamaat in the sehn?)
A: If they perform their Salaah in the Musjid or sehn of the Musjid, they should perform their Salaah individually.

قال الشامي : قوله ( وتكرار الجماعة ) لما روى عبد الرحمن بن أبي بكر عن أبيه أن رسول الله صلى الله عليه وسلم خرج من بيته ليصلح بين الأنصار فرجع وقد صلى في المسجد بجماعة فدخل رسول الله صلى الله عليه وسلم في منزل بعض أهله فجمع أهله فصلى بهم جماعة ولو لم يكره تكرار الجماعة في المسجد لصلى فيه وروي عن أنس أن أصحاب رسول الله صلى الله عليه وسلم كانوا إذا فاتتهم الجماعة في المسجد صلوا في المسجد فرادى ولأن التكرار يؤدي إلى تقليل الجماعة لأن الناس إذا علموا أنهم تفوتهم الجماعة يتعجلون فتكثر وإلا تأخروا ا هـ بدائع وحينئذ فلو دخل جماعة المسجد بعدما صلى أهله فيه فإنهم يصلون وحدانا وهو ظاهر الرواية ظهيرية (رد المحتار 1/ 395)

Q: But some say it is better to accomplish the Salaah in congregation, since there are many Ahaadith showing the virtues of prayer in congregation. Is there any Ahadith showing that it is better to perform the Salaah individually in case the person arrives late for the Salaah at the musjid?
A: It is not permissible for them to make a second jamaat in the musjid or the sehn of the Musjid that is part of the Musjid (i.e. the sehn of certain Masaajid are part of the Musjid). However if the sehn is not part of the Musjid as is the case of many Masaajid, then it is permissible for them to make a second jamaat in that area. However, they should not make it a habit of omitting the main jamaat and making a second jamaat in the sehn that is out of the Musjid.
