In which of the following cases will sajda-e-sahw be waajib

Q: What is the case if one recites in his Salaah:

  1. Surah fatiha (right after one another) twice in one of the first two rakats.
  2. Surah fatiha after the surah one has read after surah fatiha.
  3. Surah fatiha twice in the last two rakaats.
  4. At-tahiyyaat twice in the first sitting.
  5. At-tahiyyaat twice in the last sitting one after another.
  6. At-tahiyyaat again after the durood ibrahimiyyah
  7. Durood ibrahimiyyah one after another.

In which cases one must repeat the prayer as makruh tahrimi act was carried out?

A:

  1. If one recited Surah Faatiha twice, one after the other, in one of the first two rakaats, Sajda-e-sahw will be waajib upon him.
  2. If a person recited Surah Faatiha and thereafter a Surah and then repeated the Surah Faatiha, sajda-e-sahw will not be waajib.
  3. If a person recited Surah Faatiha twice in one of the last two rakaats, Sajda-e-sahw will not be waajib upon him.
  4. Through reciting attahiyaat twice in the first qa'dah sajda-e-sahw will be waajib.
  5. Through reciting attahiyaat twice, one after the other, in the last qa'dah sajda-e-sahw will not be waajib.
  6. If a person recited attahiyyat after durood-e-Ebrahim in the last Qa'dah, sajda-e-sahw will not be waajib.
  7. If a person recited Durood-e-Ebrahim twice, sajda-e-sahw will not be waajib.

وإذا قرأ في الأوليين أو أحدهما الفاتحة مرتين على الولاء يلزمه سجود السهو ولو قرأ الفاتحة ثم السورة ثم الفاتحة لا سهو عليه كذا في الظهيرية وهكذا في التجنيس وهو الأصح هكذا في الزاهدي (فتاوى هندية 1/71)

فلو قرأها في ركعة من الأوليين مرتين وجب سجود السهو لتأخير الواجب وهو السهو كما في الذخيرة وغيرها وكذا لو قرأ أكثرها ثم أعادها كما في الظهيرية أما لو قرأها قبل السورة مرة وبعدها مرة فلا يجب كما في الخانية واختاره في المحيط والظهيرية والخلاصة وصححه الزاهدي لعدم لزوم التأخير لأن الركوع ليس واجبا بإثر السورة فإنه لو جمع بين سور بعد الفاتحة لا يجب عليه شيء كذا في البحر هنا وفي سجود السهو قال في شرح المنية وقيد بالأوليين لأن الاقتصار على مرة في الأخريين ليس بواجب حتى لا يلزمه سجود السهو بتكرار الفاتحة فيهما سهوا ولو تعمده لا يكره ما لم يؤد إلى التطويل على الجماعة أو إطالة الركعة على ما قبلها ا هـ (رد المحتار 1/460)

ولو قرأ آية في الركوع أو السجود أو القومة فعليه السهو ولو قرأ في القعود ان قرأ قبل التشهد في القعدتين فعليه السهو لترك واجب الابتداء بالتشهد أول الجلوس وإن قرأ بعد التشهد فإن كان في الأول فعليه السهو لتأخير الواجب وهو وصل القيام بالفراغ من التشهد وإن كان في الأخير فلا سهو عليه لعدم ترك واجب لأنه موسع له في الدعاء والثناء بعده فيه والقراءة تشتمل عليهما ولو قرأ التشهد مرتين في القعدة الأخيرة أو تشهد قائما أو راكعا أو ساجدا لا سهو عليه منية المصلي  (حاشية الطحطاوي على مراقي الفلاح صـ 461)

ولو كرر التشهد في القعدة الأولى فعليه السهو وكذا لو زاد على التشهد الصلاة على النبي - صلى الله عليه وسلم -، كذا في التبيين وعليه الفتوى، كذا في المضمرات واختلفوا في قدر الزيادة فقال بعضهم: يجب عليه سجود السهو بقوله: اللهم صل على محمد وقال بعضهم: لا يجب عليه حتى يقول: وعلى آل محمد والأول أصح.(الفتاوى الهندية 1/127)

Q: What if in all these cases, he did it not out of mistake or forgetfullness but he did it on purpose? Must he repeat to make up for the deficiency since he did on purpose a act of makruh tahrimi?

  1. If one intentionally recited Surah Faatiha twice, one after the other, in one of the first two rakaats, the Salaah will have to be repeated as long as the time remains.
  2. If a person intentionally recited Surah Faatiha and thereafter a Surah and then repeated the Surah Faatiha, sajda-e-sahw will not be waajib.
  3. If a person intentionally recited Surah Faatiha twice in one of the last two rakaats, Sajda-e-sahw will not be waajib upon him.
  4. Through intentionally reciting attahiyaat twice in the first qa'dah, the Salaah will have to be repeated as long as the time remains.
