Wakeel using the zakaat and thereafter paying the zakaat from his own wealth
Q: I have a relative who is liable for zakaat. I informed my aunt that I am collecting zakaat for someone without giving the name. My aunt gave me R500 Zakaat. I then went to the shop for buying something but ran short of money. I used the R500 with the view of replacing with my own money later. I then took my own R500 and gave it to my relative. Is my aunt's zakaat discharged?
A: The zakaat will not be discharged through spending it for your own needs and thereafter giving the equivalent to the poor from your own wealth. You should inform your aunt that you had spent the zakaat money for your needs and thereafter take her permission to discharge her zakaat from your wealth. After taking her permission, it will be permissible for you to give her zakaat from your wealth.

إن كان صرف المال الذي دفعه الآمر في حاجته ثم دفعها من مال نفسه فهذا لايجوز لأنه لما أنفقه صار مضمونا عليه فلا يبرأ إلا بالأداء إلى المالك (الفتاوى التاترخانية 2/284)
دفع دراهم لإنسان يدفعها زكاة ماله فأمسكها ودفع من دراهم نفسه فإن كانت دراهم الآمر هالكة أو مستهلكة كان دفعه تبرعا ولا يرجع به وما استهلكه دين في ذمته (حاشية الطحطاوي على الدر 1/394)
ولو تصدق بدراهم نفسه أجزأ إن كان على نية الرجوع وكانت دراهم الموكل قائمة
قال الشامي: (قوله ولو تصدق إلخ) أي الوكيل بدفع الزكاة إذا أمسك دراهم الموكل ودفع من ماله ليرجع ببدلها في دراهم الموكل صح. بخلاف ما إذا أنفقها أولا على نفسه مثلا ثم دفع من ماله فهو متبرع، وعلى هذا التفصيل الوكيل بالإنفاق أو بقضاء الدين أو الشراء كما سيأتي إن شاء الله تعالى في الوكالة.
