Hiring someone to go fishing
Q: I have a few friends who go fishing and hire boys to assist them while fishing. The boys prepare the rods for them, ensure that there is enough fishing line on the rod, and place the bait on the rod, etc. At times, these boys also hold the rod and fish when my friends want a break. If they catch any fish, they give it to my friends. Is this permissible?
A: It is permissible to hire them for these services. However, they should not be hired for holding the rod and fishing. Hiring someone to catch fish is not recognized in Shari’ah as a valid ijaarah and is hence impermissible. If any fish is caught, it will belong to the one who catches the fish, and the one who caught the fish will have to pay for the use of the rod to the person whose rod he used.

(ولا تجوز الشركة في الاحتطاب والاصطياد وما اصطاده كل واحد منهما أو احتطبه فهو له دون صاحبه) وعلى هذا الاشتراك في أخذ كل شيء مباح لأن الشركة متضمنة معنى الوكالة والتوكيل في أخذ المال المباح باطل لأن أمر الموكل به غير صحيح والوكيل يملكه بدون أمره فلا يصلح نائبا عنه وإنما يثبت الملك لهما بالأخذ وإحراز المباح فإن أخذاه معا فهو بينهما نصفان لاستوائهما في سبب الاستحقاق وإن أخذه أحدهما ولم يعمل الآخر شيئا فهو للعامل وإن عمل أحدهما وأعانه الآخر في عمله بأن قلعه أحدهما وجمعه الآخر أو قلعه وجمعه وحمله الآخر فللمعين أجر المثل بالغا ما بلغ عند محمد وعند أبي يوسف لا يجاوز به نصف ثمن ذلك وقد عرف في موضعه (وإذا اشتركا ولأحدهما بغل وللآخر راوية يستقي عليها الماء فالكسب بينهما لم تصح الشركة والكسب كله للذي استقى وعليه أجر مثل الراوية إن كان العامل صاحب البغل وإن كان صاحب الراوية فعليه أجر مثل البغل) (الهداية 3/13)
