Changing the nisaab from silver to gold

Q: Lately I was informed that on account of the price of the Qurbaani animals increasing in certain places, some scholars have suggested that the Nisaab should change from silver to gold to make it easy for the people so that they will not have to do the Qurbaani. Will it be permissible for one to accept this opinion and pay Zakaat and do Qurbaani only if one possesses wealth that equals the gold Nisaab? The silver Nisaab is 612,36g of silver, which, at present, is approximately R4 764 and the gold Nisaab is 87,48g of gold which, at present, is approximately R50 000. According to this, a lot of people who possess wealth less than R50 000, but more than R4 764 will not have to do Qurbaani and nor will they have to discharge Zakaat.

A: In the classical books of Fiqh, the Fuqaha mention that the Nisaab of Zakaat will either be stipulated through the silver Nisaab or the gold Nisaab. In determining which of the two will be preferred, the Fuqaha unanimously state that one will see which of the two will be more beneficial for the Fuqara. The one that will bring more benefit to the Fuqara will be preferred.

When examining both Nisaabs, we find the lower Nisaab to be the means of the Fuqara benefiting more. This is so, because through Zakaat being stipulated with the lower Nisaab, more people will be obligated to discharge Zakaat, and in turn, the Fuqara will benefit more. 

If the Zakaat Nisaab is stipulated with the higher Nisaab, then people who possess wealth equal to the lower Nisaab, or more than the lower Nisaab but less than the higher Nisaab, will not have to pay Zakaat. As a result, less people will pay Zakaat and consequently, less benefit will come to the Fuqara.

Through all the centuries, the benefit of the Fuqara was always made the criteria for determining the Nisaab. From the two Nisaabs (the Nisaab of gold and silver), the Nisaab of silver was always lower than the gold Nisaab and hence it was always made the Nisaab for stipulating the Zakaat. Hence, the Fuqaha state that if a person possesses wealth which reaches the lower Nisaab but does not reach the higher Nisaab, Zakaat will be compulsory on him, as this is the means for the Fuqara benefiting more.  

If the Nisaab is changed from silver to gold in the Mas’alah of Qurbani in order to make it easy for people, so that Qurbani does not become Waajib on them, one will have to also change the Nisaab in the mas’alah of Zakaat. The reason is that the same principle that the fuqahaa explain in regard to the Nisaab of Qurbaani is explained for the Nisaab of Zakaat. When viewing the Nisaab of Qurbaani, the Fuqaha clearly state that if one possess wealth that reaches the lower Nisaab, Qurbaani will be Waajib on him and if one possesses wealth which reaches the lower Nisaab, Zakaat will be Waajib.

Hence, we find that in both cases the obligation of Qurbaani and Zakaat are based on the lower Nisaab. When Zakaat and qurbani follow the same principle, it will not be possible to ear mark one Nisaab for Zakaat and another Nisaab for Qurbaani, as this goes against the clear verdict of the Fuqahaa. Apart from this, this goes against the ta’aamul (accepted practice) of the ummah for centuries, that they did not make a distinction between the Nisaab of Zakaat and the Nisaab of Qurbaani. Therefore, the lower Nisaab will always be the basis for both these obligations becoming Waajib on a person.

Throughout the centuries of Islam, one Nisaab was always made the basis for determining the laws in all the Masaa’il that are related to the Nisaab. Hence, if the price of the Qurbani animals increase, people who possess wealth which reaches the lower Nisaab or more will still have to perform Qurbani.

Furthermore, Qurbani only becomes Waajib on an individual once a year. It does not seem logical that on account of the price of the Qurbani animals increasing in certain places, the entire Nisaab should change from silver to gold for the entire ummah. 

In fact, the Fuqaha clearly state that there is a difference between the Nisaab which makes Qurbaani Waajib compared to the Nisaab which makes Zakaat Waajib (though the both relate to the lower Nisaab). If one possesses wealth which equals the Nisaab (regardless of whether the wealth was Zakaatable or not e.g. owning old clothes which one no longer intends using, owning a television, Dvd player or Hifi), though zakaat will not be Waajib on him, but Qurbaani will be Waajib on him. From this we understand that the Nisaab which makes Qurbaani Waajib on a person is more stringent than the Nisaab which makes Zakaat Waajib. Thus, through one possessing the above items, he will be required to sell them in order to acquire the money for performing Qurbaani.      

If the Nisaab is changed from silver to gold, a major problem that the Ummah will face is that those who possess wealth equal to or more than the silver Nisaab, but less than the gold Nisaab, will no longer be obligated to pay Zakaat to the poor. Instead, they themselves will become recipients of Zakaat. Hence, the rich who possess wealth equal to the Nisaab of gold or more will now have to spend their Zakaat on two classes of people, the middle class (those who possess wealth equal to or more than the silver Nisaab but less than the gold Nisaab), as well as the poor class (those who possess wealth less than the silver Nisaab).

The outcome of this will be that since the middle class will no longer be spending their wealth on the poor class, and the wealthy class will be distributing their wealth between the middle class and poor class,  the poor class (who were the actual recipients of Zakaat) will be left with much less than what they were receiving previously, when the middle and wealthy classes were both paying Zakaat to them. This goes against the very purpose of Zakaat which is to benefit the poor and fulfil their needs.

In conclusion, changing the Nisaab from silver to gold opposes the clear verdict of the Fuqaha and goes against the ta’aamul (accepted practice) of the ummah for centuries. Apart from this, it goes against the very spirit and objective of deen which is to benefit the poor. This change of Nisaab will really be detrimental to the poor, especially in this time, when the Ummah is currently undergoing a crisis in all parts of the globe and are in dire need of the Ummah opening their hearts and spending their wealth (zakaat, lillah, qurbaani, sadaqah, etc.) on them.

And Allah Ta'ala (الله تعالى) knows best.

فالحاصل أن المذهب تخييره إلا إذا كان لا يبلغ بأحدهما نصابا تعين التقويم بما يبلغ نصابا وهو مراد من قال يقوم بالأنفع ولذا قال في الهداية وتفسير الأنفع :الأنفع أن يقومها بما يبلغ نصابا (البحر الرائق 2/246)

ثم في تقويم عروض التجارة التخيير يقوم بأيهما شاء من الدراهم والدنانير إلا إذا كانت لا تبلغ بأحدهما نصابا فحينئذ تعين التقويم بما يبلغ نصابا هكذا في البحر الرائق (الفتاوى الهندية 1/179)

ولو بلغ بأحدهما الآخر تعين ما يبلغ به (الدر المختار  2/299)

( قوله يقومها بما هو أنفع للفقراء والمساكين ) تفسير الأنفع أن يقومها بما يبلغ نصابا عند أبي حنيفة وعند أبي يوسف بما اشتراه إن كان الثمن من النقود وإن اشتراه بغير النقود قومها بالنقد الغالب وعند محمد بالنقد الغالب على كل حال سواء اشتراها بأحد النقدين أو بغيره والخلاف فيما إذا كانت تبلغ بكلا النقدين نصابا أما إذا بلغت بأحدهما قومها بالبالغ إجماعا (الجوهرة النيرة 1/478)

وعن أبي حنيفة أنه يقوم بما فيه إيجاب الزكاة، حتى إذا بلغ بالتقوم بأحدهما نصاباً ولم يبلغ بالآخر قوم بما يبلغ نصاباً، وهو إحدى الروايتين عن محمد. (المحيط البرهاني 2/432)

ألا ترى أنه لو كان بالتقويم بأحدهما يتم النصاب وبالآخر لا فإنه يقوم بما يتم به النصاب نظرا للفقراء واحتياطا (بدائع الصنائع 2/21)

كما في عروض التجارة لما لم يمكن اعتباره رددناه إلى النقدين واعتبار الأدنى لكونه أنفع للفقراء (تبيين الحقائق 1/293)

فلو كان يتم بأحدهما دون الآخر قوم بما يصير به نصابا انتهى (فتح القدير 2/220)

و تجب الزكاة أيضا في عروض تجارة بلغت قيمتها نصابا من أحدهما أي الذهب والفضة تقوم أي عروض التجارة بما هو أنفع للفقراء أيهما كان لقوله عليه الصلاة والسلام يقومها فيؤدي من كل مائتي درهم خمسة دراهم وهذا عند الإمام يعني نقوم بما يبلغ نصابا إن كان يبلغ بأحدهما دون الآخر احتياطا في حق الفقراء كما في التبيين(مجمع الأنهر 1/306)

وتقوم العروض بما هو أنفع للفقراء فإن بلغت قيمتها نصابا من أحد النقدين دون الآخر قومت بما بلغت به نصابا من غير التفات للآخر(نور الإيضاح 128)

وشرائطها الإسلام والإقامة واليسار الذي يتعلق به ) وجوب ( صدقة الفطر ) كما مر (الدر المختار 6/312)

قال العلامة ابن عابدين رحمه الله :قوله ( واليسار إلخ ) بأن ملك مائتي درهم أو عرضا يساويها غير مسكنه وثياب اللبس أو متاع يحتاجه إلى أن يذبح الأضحية ولو له عقار يستغله فقيل تلزم لو قيمته نصابا وقيل لو يدخل منه قوت سنة تلزم وقيل قوت شهر فمتى فضل نصاب تلزمه ولو العقار وقفا فإن وجب له في أيامها نصاب تلزم وصاحب الثياب الأربعة لو ساوى الرابع نصابا غني وثلاثة فلا لأن أحدها للبذلة والآخر للمهنة والثالث للجمع والوفد والأعياد والمرأة موسرة بالمعجل لو الزوج مليا وبالمؤجل لا وبدار تسكنها مع الزوج إن قدر على الإسكان  له مال كثير غائب في يد مضاربه أو شريكه ومعه من الحجرين أومتاع البيت ما يضحي به تلزم  وتمام الفروع في البزازية وغيرها (رد المحتار 6/312)

وشرط وجوبها اليسار عند أصحابنا رحمهم الله، والموسر في ظاهر الرواية من له مائتا درهم، أو عشرون ديناراً، أو شيء يبلغ ذلك سوى مسكنه ومتاع مسكنه ومتاعه ومركوبه وخادمه في حاجته التي لا يستغني عنها ( المحيط البرهاني 6/85 والفتاوى التاتارخانية 17/405)

الباب الثامن في صدقة الفطر  وهي واجبة على الحر المسلم المالك لمقدار النصاب فاضلا عن حوائجه الأصلية كذا في الاختيار شرح المختار ولا يعتبر فيه وصف النماء ويتعلق بهذا النصاب وجوب الأضحية ووجوب نفقة الأقارب هكذا في فتاوى قاضي خان ( الفتاوى الهندية 1/191)

وقدر اليسار بالنصاب لتقدير الغنى في الشرع به فاضلا عما ذكر من الأشياء لأنها مستحقة بالحاجة الأصلية والمستحق بالحاجة الأصلية كالمعدوم ولا يشترط فيه النمو ويتعلق بهذا النصاب حرمان الصدقة ووجوب الأضحية والفطرة ( الهداية 1/115)

واليسار لما روينا ولأن العبادة لا تجب إلا على القادر , وهو الغني دون الفقير , ومقداره ما يجب فيه صدقة الفطر( تبيين الحقائق 6/3)

وأما شرائط الوجوب فمنها اليسار وهو اليسار الذي تعلق به وجوب صدقة الفطر دون اليسار الذي تعلق به وجوب الزكاة على ما ذكرنا في كتاب الزكاة(تحفة الفقهاء 3/82)

.... ( ذي نصاب فاضل عن حاجته الأصلية ) كدينه وحوائج عياله ( وإن لم ينم ) كما مر ( وبه ) أي بهذا النصاب ( تحرم الصدقة ) كما مر وتجب الأضحية ونفقة المحارم على الراجح(الدر المختار 2/361)
