Can the one appointed to purchase make a profit?
Q: I need Shar'ee guidance regarding a certain trading transaction:
My relative asked me to buy a washing machine for him. The washing machine cost Rs.3000 for example.
1. Can I inform my relative that the machine cost Rs.5,000? He does not know that I will charge him extra.
2. Can I first inform my relative that I started selling washing machines and then charge him Rs.5,000?
A: If he has appointed you to purchase the washing machine for him, then it will not be permissible for you to take Rs 5000 from him. The extra Rs 2000 will be haraam. However, if you wish to earn halaal wealth through a permissible sale, then inform him that you will not purchase the washing machine for him, but rather you will purchase it for yourself and thereafter sell it to him with a profit. In this way, the extra money will be halaal for you.

الوكيل بشراء شيء بعينه لا يملك أن يشتريه لنفسه وإذا اشترى يقع الشراء للموكل لأن شراءه لنفسه عزل لنفسه عن الوكالة وهو لا يملك ذلك إلا بمحضر من الموكل كما لا يملك الموكل عزله إلا بمحضر منه على ما نذكره في موضعه إن شاء الله تعالى وأما الوكيل بشراء شيء بغير عينه إذا اشترى يكون مشتريا لنفسه إلا أن ينويه للموكل.(بدائع الصنائع 2/23)
قال البيع ينعقد بالإيجاب والقبول إذا كانا بلفظي الماضي مثل أن يقول أحدهما بعث والآخر اشتريت لأن البيع إنشاء تصرف والإنشاء يعرف بالشرع والموضوع للإخبار قد استعمل فيه فينعقد به ولا ينعقد بلفظين أحدهما لفظ المستقبل والآخر لفظ الماضي بخلاف النكاح وقد مر الفرق هناك وقوله رضيت بكذا أو أعطيتك بكذا أو خذه بكذا في معنى قوله بعت واشتريت لأنه يؤدي معناه والمعنى هو المعتبر في هذه العقود ولهذا ينعقد بالتعاطي في النفيس والخسيس وهو الصحيح لتحقق المراضاة.(الهداية 3/21)
