If I ever speak to you, my coming wife will be divorced
Q: My question is that one of my friends had a fight with his friend and in anger he said to him that `if I ever talk to you, my coming wife will have a (kullama) divorce.' While saying this no women was in his mind, I mean whosoever he will marry she will have a kullama divorce. Now he wants to talk to that person again and wants to get married also. What is the solution?
A: Please confirm the exact words uttered by your friend. Was he married at the time of saying these words. Further what does he mean by ‘Kullama’?
Q: That guy wasn't married at that time but now he is going to marry soon and on the other hand he wanted to talk with that guy whom he had a fight and he said in anger that if I ever talk to you, my coming wife will have a kullama divorce. Kullama is an Arabic word which means (whenever). Is there any solution that he can get married and can begin his friendship again with that guy?
A: The talaaq does not take place as there is no idhaafat made to sabab-e-milk. You may refer to other ulama as well.
باب الأيمان في الطلاق وإذا أضاف الطلاق إلى النكاح وقع عقيب النكاح مثل أن يقول لامرأة إن تزوجتك فأنت طالق أو كل امرأة أتزوجها فهي طالق وقال الشافعي رحمه الله لا يقع لقوله عليه الصلاة والسلام لا طلاق قبل النكاح ولنا أن هذا تصرف يمين لوجود الشرط والجزاء فلا يشترط لصحته قيام الملك في الحال لأن الوقوع عند الشرط والملك متيقن به عنده وقبل ذلك أثره المنع وهو قائم بالمنصرف والحديث محمول على نفي التنجيز والحمل مأثور عن السلف كالشعبي والزهري وغيرهما وإذا أضافه إلى شرط وقع عقيب الشرط مثل أن يقول لامرأته إن دخلت الدار فأنت طالق وهذا بالاتفاق لأن الملك قائم في الحال والظاهر بقاؤه إلى وقت وجود الشرط فيصح يمينا أو إيقاعا ولا تصح إضافة الطلاق إلا أن يكون الحالف مالكا أو يضيفه إلى ملك لأن الجزاء لا بد أن يكون ظاهرا ليكون مخيفا فيتحقق معنى اليمين وهو القوة والظهور بأحد هذين والإضافة إلى سبب الملك بمنزلة الإضافة إليه لأنه ظاهر عند سببه (الهداية 2/ 385)
