Uttering words of kufr
Q: Whenever I tell my husband to read his Salaah, he jokes around and tells me no he is not reading because he is a Christian naauzubillah. By him uttering such words, does it break my nikkah?
A: These are extremely severe words for a Muslim to utter. Through uttering such words one comes out of the fold of Islam. Your husband should sincerely repent for uttering such a statement. He should repeat the kalimah and renew his nikaah. You should refrain from having relations with him until he sincerely repents, repeats the kalima and renews his nikah.

لو قال لمريض صل فقال والله لا أصلي أبدا ولم يصل حتى مات يكفر وقول الرجل لا أصلي يحتمل أربعة أوجه أحدها لا أصلي لأني صليت والثاني لا أصلي بأمرك فقد أمرني بها من هو خير منك والثالث لا أصلي فسقا مجانة فهذه الثلاثة ليست بكفر والرابع لا أصلي إذ ليس يجب علي الصلاة ولم أؤمر بها يكفر (الهندية 2/268)
وإن كانت نيته الوجه الذي يوجب التكفير لا تنفعه فتوى المفتي ويؤمر بالتوبة والرجوع عن ذلك وبتجديد النكاح بينه وبين امرأته كذا في المحيط (الهندية 2/283)
الهازل أو المستهزئ إذا تكلم بكفر استخفافا واستهزاء ومزاحا يكون كفرا عند الكل وإن كان اعتقاده خلاف ذلك (الهندية 2/276)
والحاصل أن من تكلم بكلمة الكفر هازلا أو لاعبا كفر عند الكل ولا اعتبار باعتقاده (شامي 4/224)
