Facilitating a “budget” credit card transaction
Q: When our customers pay using credit cards, is it permissible for us to allow them to choose the “budget” option?
A: Just as it is not permissible for one to deal in interest, similarly it is not permissible for one to aid and support others in acquiring interest-bearing loans. By allowing the customer to use your machine and select the “budget” option, you will be a party to the sin of interest even though the sale of the merchandise to the client will be halaal. Hence it is not permissible for you to allow the customer to use your machine for this option.
Nevertheless, if one had sold merchandise and allowed the customer the use of the machine, and the customer selected the budget option, one should sincerely repent for assisting and aiding the customer in acquiring an interest-bearing loan.
If the customer wishes to choose the “straight” option, it will be permissible as the transaction will not incur interest.

وَتَعَاوَنُوۡا عَلَی الۡبِرِّ وَ التَّقۡوٰی وَلَا تَعَاوَنُوۡا عَلَی الۡاِثۡمِ وَ الۡعُدۡوَانِ (المائدة: ٢)
عن جابر رضي الله عنه قال لعن رسول الله صلى الله عليه وسلم آكل الربا وموكله وكاتبه وشاهديه وقال هم سواء (صحيح مسلم، الرقم: 106)
(وجاز بيع العصير من خمار) لأن المعصية لا تقوم بعينه بل بعد تغيره بخلاف بيع السلاح من أهل الفتنة لأن المعصية تقوم بعينه فيكون إعانة لهم وتسبيبا وقد نهينا عن التعاون على العدوان والمعصية ولأن العصير يصلح الأشياء كلها جائز شرعا فيكون الفساد إلى اختياره (تبيين الحقائق 6/29)
قال العلامة الشلبي رحمه الله (قوله وقالا هو مكروه) قال فخر الإسلام قول أبي حنيفة قياس وقولهما استحسان اهـ غاية وكتب ما نصه لأنه إعانة على المعصية فيكره لقوله تعالى ولا تعاونوا على الإثم والعدوان اهـ غاية (حاشية الشلبي على تبيين الحقائق 6/29)
يجوز بيع العصير ممن يعلم أنه يتخذه خمرا مع الكراهة (النهر الفائق 3/429)
الرابعة ما في عامة الكتب من أنه إذا كان في مسألة قياس واستحسان ترجح الاستحسان على القياس إلا في مسائل (شرح عقود رسم المفتي صـ 94)
