Demise of the creditor before the payment is due
Q: My father sold a car for R100 000 on credit and the terms were that the customer would pay R25 000 per month over four months. My father has passed away and it is two months since he concluded the sale. Can we make the customer pay the remaining R50 000 immediately or does he still have two months left to pay?
A: When the creditor passes away before the payment is due, the nature of the debt does not change and the terms still remain. Hence the customer still has two months to pay and you cannot claim the outstanding R50 000 immediately.

ويبطل الأجل بموت المديون لا الدائن (الدر المختار 4/532)
قال العلامة ابن عابدين رحمه الله (قوله ويبطل الأجل بموت المديون) لأن فائدة التأجيل أن يتجر فيؤدي الثمن من نماء المال فإذا مات من له الأجل تعين المتروك لقضاء الدين فلا يفيد التأجيل بحر عن شرح المجمع وصرح قبله بأنه لو مات البائع لا يبطل الأجل (رد المحتار 4/532)
