Seeking repentance for one's past sins before marriage
Q: If a man and woman commit zina before getting married. After their marriage, they had children and realized that what they have done before marriage was a sin. But they do not repent when being married because they dont have knowlegde that before marriage they had to repent.
After 6 years they got to know that they should have repented before nikaah, otherwise their nikaah is invalid. Is their nikaah valid or not as they repented after 6 years of marriage.
A: The nikaah is valid. Seeking repentance for one's past sins is not a precondition for the validity of the nikaah. However, one should not delay in making taubah for the sins one had committed.

وأما ركن النكاح فهو الإيجاب والقبول (بدائع الصنائع 2/229)
وحلّ تزوّج الكتابيّة والصّابئة والمحرمة ... وحبلى من زنًا لا من غيره (كنز الدقائق صـ 253)
(قوله وحبلى من زنا لا من غيره) أي وحل تزوج الحبلى من الزنا ولا يجوز تزوج الحبلى من غير الزنا أما الأول فهو قولهما، وقال أبو يوسف هو فاسد قياسا على الثاني وهي الحبلى من غيره وإن تزوجها لا يصح إجماعا لحرمة الحمل وهذا الحمل محترم لأنه لا جناية منه ولهذا لم يجز إسقاطه ولهما أنهما من المحللات بالنص وحرمة الوطء كي لا يسقي ماءه زرع غيره والامتناع في ثابت النسب لحق صاحب الماء ولا حرمة للزاني ومحل الخلاف تزوج غير الزاني، أما تزوج الزاني لها فجائز اتفاقا (البحر الرائق شرح كنز الدقائق 3/114)
