Husband says "I am giving you 2 talaqs." Then he says, "Never mind, I will give you 1."
Q: An argument ensued between a husband and wife. The husband with gesture, shows 2 fingers and says, "I am giving you 2 talaqs." Then he says, "Never mind, I will give you 1." The husband was extremely raged at this juncture and walks out. What is the status of the marriage?
A: If he said "I am giving you two talaaqs" while gesturing with two fingers, then two talaaqs have taken place. Thereafter, by him saying, "Never mind, I will give you one talaaq", he will not be able to decrease the number of two talaaqs to one talaaq, as both have already taken place. Hence, through saying, "Never mind, I will give you one talaaq", the third talaaq will take place.
And Allah Ta'ala (الله تعالى) knows best.
ولو قال: أنت طالق واحدة لا بل اثنتين فهي طالق ثلاثا إن كان دخل بها لأن كلمة لا بل لاستدراك الغلط بإقامة الثاني مقام الأول والرجوع عن الأول وهو لا يملك الرجوع عما أوقعه ولكنه يتمكن من إيقاع أخريين إذا كان قد دخل بها فتطلق ثلاثا لهذا وإن لم يكن دخل بها فهي واحدة (المبسوط للسرخسي 6/125)
ولو قال للمدخولة أنت طالق واحدة لا بل ثنتين يقع الثلاث (الفتاوى الهندية 1/362)
ولو قال انت طالق ثلاثا لا بل واحدة فانها ثلاث في قول ابي حنيفة واصحابه (النتف في الفتاوى 1/352)
