Intercourse after haidh before making ghusal
Q: Once my wife’s periods finished, we had sexual intercourse before she could take ghusal (bath), really we fear azaab (punishment) of Allah Subhanu Wata’aala on this matter. May Allah forgive me for this and guide me to spend my life according to the Sharia.
A: If she had bled for ten complete days then this is permissible. However, if she bled for less than ten days and then it is not permissible to share the bed with her before she could have ghusl or one salaah time passes. Make taubah for this and ask Allah Ta`ala to forgive both of you.
( ويحل وطؤها إذا انقطع حيضها لأكثره ) بلا غسل وجوبا بل ندبا ( وإن ) انقطع لدون أقله تتوضأ وتصلي في آخر الوقت وإن ( لأقله ) فإن لدون عادتها لم يحل وتغتسل وتصلي وتصوم احتياطا وإن لعادتها فإن كتابية حل في الحال وإلا ( لا ) يحل ( حتى تغتسل ) أو تتيمم بشرطه ( أو يمضي عليها زمن يسع الغسل ) ولبس الثياب ( والتحريمة ) يعني من آخر وقت الصلاة لتعليلهم بوجوبها في ذمتها (الدر المختار 1/294)
