Ijaab and Qabool in the presence of witnesses

Q:

1. If a proposal and acceptance take place between a man or woman so are they married. Is this valid or legal in shariah.

Once in a TV program I heard that if a Muslim man and woman accept their proposal and accept each other then they are married and nikah takes place even if no one is present in between them. He said that this is called Nikah Ijaab and Qabool. Ss this true?

2. I also heard that for nikah Ijaab and Qabool​ permission, wish or willing of a woman's father is necessary.

3. If a man and woman accept each other in the presence of her mother and her 14 years old brother, so in this case nikah takes place or not?

4. If a father of a woman wishes to marry her daughter with his sister son (Nephew) and both the girl and boy are fiancee and fiance and both the parents wish to marry them but both girl and boy accept each other saying nikah words in the absence of any witness and both parents are also not present at that time so in this case nikaah takes place or not?

1. If there are no witnesses present, the nikaah will not be valid.

2. A women should consult her parents before she gets married. She should not independantly perform her nikaah.

قال ولا ينعقد نكاح المسلمين إلا بحضور شاهدين حرين عاقلين بالغين مسلمين رجلين أو رجل وامرأتين عدولا كانوا أو غير عدول أو محدودين في القذف قال رضي الله عنه اعلم أن الشهادة شرط في باب النكاح لقوله عليه الصلاة والسلام لا نكاح إلا بشهود (هداية 2/306)

ثم المرأة إذا زوجت نفسها من غير كفء صح النكاح في ظاهر الرواية عن أبي حنيفة رحمه الله تعالى وهو قول أبي يوسف رحمه الله تعالى آخرا وقول محمد رحمه الله تعالى آخرا أيضا حتى أن قبل التفريق يثبت فيه حكم الطلاق والظهار والإيلاء والتوارث وغير ذلك ولكن للأولياء حق الاعتراض وروى الحسن عن أبي حنيفة رحمه الله تعالى أن النكاح لا ينعقد وبه أخذ كثير من مشايخنا رحمهم الله تعالى كذا في المحيط والمختار في زماننا للفتوى رواية الحسن وقال الشيخ الإمام شمس الأئمة السرخسي رواية الحسن أقرب إلى الاحتياط كذا في فتاوى قاضي خان في فصل شرائط النكاح (الفتاوي الهندية 1/321-322)

أما على رواية الحسن المختارة للفتوى من أنه لا يصح فالمعنى معتبرة في الصحة وكذا لو كانت الزوجة صغيرة والعاقد غير الأب والجد فقد مر أن العقد لا يصح قوله ( في ابتداء النكاح ) يغني عنه قول المصنف الآتي واعتبارها عند ابتداء العقد الخ وكأنه أشار إلى أن الأولى ذكره هنا قوله ( للزوجه أو لصحته ) الأول بناء على ظاهر الرواية والثاني على رواية الحسن وقدمنا أول الباب السابق اختلاف الإفتاء فيهما وأن رواية الحسن أحوط  (رد المحتار 3/84)
