Cutting the wife's hair in the state of ihraam
Q: I humbly request guidance on the matter of cutting hair in ihraam. What is the hanafi ruling on a person in the state of ihraam himself cutting the hair of his wife to come out of ihraam after completing the umrah? Is it allowed or is this a violation of ihraam? If it is a violation, will damm be due on the man?
A: If both the husband and wife have completed all the acts of umrah and cutting the hair is the only act that remains, then it is permissible for the husband and wife to cut each other's hair in order to come out of the state of ihraam. Damm will not be waajib.
And Allah Ta'ala (الله تعالى) knows best.
ولو حلق رأسه أو رأس غيره من حلال أو محرم جاز له الحلق لم يلزمهما شيء (غنية الناسك صــ 174)
(وإذا حلق) أي المحرم (رأسه) أي رأس نفسه (أو رأس غيره) أي ولو كان محرماً (عند جواز التحلل) أي الخروج من الإحرام بأداء أفعال النسك (لم يلزمه شيء) الأولى لم يلزمهما شيء وهذا حكم يعم كل محرم في كل وقت فلا مفهوم لتقييد المصنف في الكبير بقوله عند جواز الحلق يوم النحر (شرح المناسك للملا علي القاري صـ 324)
