Distributing the estate according to Shari'ah
Q: When a person dies and one out of three sons wants to distribute the inheritance according to Islamic laws but the other two don't want to get it distributed and want to let it remain under the wife's control. Can the son who demands the distribution be given his share of the inheritance or not?
A: The estate should be wound and distributed according to the laws of Shari'ah. Distributing the estate in any other way is haraam in Islam. After the estate is distributed among the heirs (according to the stipulated shares of inheritance) and each heir takes full possession and control of his share, if anyone wishes to gift their share to another heir or another person without any coercion and force, he may do so.

تِلْكَ حُدُودُ اللَّـهِ ۚ وَمَنْ يُطِعِ اللَّـهَ وَرَسُولَهُ يُدْخِلْهُ جَنَّاتٍ تَجْرِي مِنْ تَحْتِهَا الْأَنْهَارُ خَالِدِينَ فِيهَا ۚ وَذَٰلِكَ الْفَوْزُ الْعَظِيمُ ﴿١٣﴾ وَمَنْ يَعْصِ اللَّـهَ وَرَسُولَهُ وَيَتَعَدَّ حُدُودَهُ يُدْخِلْهُ نَارًا خَالِدًا فِيهَا وَلَهُ عَذَابٌ مُهِينٌ ﴿١٤﴾ ﴿النساء﴾
