Marrying Hindus and Non-Muslims

Q: If a person marries a non Muslim who doesn't convert to Islam even after marriage and also marries his Muslim sister to a hindu. Is that person and his family outside the fold of Islam?

A: Marrying hindus are haraam. Such a nikaah is not valid. Hence one will be living perpetually in zina. However, through committing this major sin one will not come out of the fold of Islam if one regards this as a sin.

And Allah Ta'ala (الله تعالى) knows best.

وَلَا تَنكِحُوا الْمُشْرِكَاتِ حَتَّىٰ يُؤْمِنَّ وَلَأَمَةٌ مُّؤْمِنَةٌ خَيْرٌ مِّن مُّشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنكِحُوا الْمُشْرِكِينَ حَتَّىٰ يُؤْمِنُوا وَلَعَبْدٌ مُّؤْمِنٌ خَيْرٌ مِّن مُّشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَـٰئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّـهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَ ﴿البقرة: ٢٢١﴾
