Employment agency
Q: An employment agency fee structure is as follows: As long as the employee works for the employer the agency will receive a percentage. Is this correct?
A: If the agency assumes complete responsibility to ensure that the work is done correctly and efficiently, it will be permissible for them to receive a percentage from the employer. If they do not assume complete responsibility to ensure that the work is done correctly and efficiently, but wish to receive a continuous commission, then this is not permissible.
And Allah Ta'ala (الله تعالى) knows best.
لأن الربح لا يستحق إلا بالمال أو العمل أو بالضمان فرب المال يستحقه بالمال والمضارب يستحقه بالعمل والأستاذ الذي يلقى العلم على التلميذ بالنصف بالضمان ولا يستحق بما سواها ألا ترى أن من قال لغيره تصرف في مالك على أن لي ربحه لم يجز لعدم هذه المعاني واستحقاق الربح في شركة الوجوه بالضمان على ما بينا (هداية 2/634)
