Husband telling the wife "Tumhe azadi ho jo chaho dekho"

Q: One day in a fight my wife on her freedom to watch any program on Television, she said she will watch anything on Television irrespective of my stoppage. I said that "Meri taraf se tumhe azadi ho jo chaho dekho lekin suba gane mat suna karo". Please advise in the light of above circumstances if my above sentence constitute Talaq e Bain as I heard azad word constitutes Talaq without any intention?

A: If the husband through saying the words "Meri taraf se tumhe azadi ho jo chaho dekho" intended that his wife is free to do as she pleases in regard to watching the program on television, then no talaaq has taken place. However if through saying "Meri taraf se tumhe azadi ho" he intended a talaaq or he did not intend anything, then one revocable talaaq has taken place.

And Allah Ta'ala (الله تعالى) knows best.

فإن سرحتك كناية لكنه في عرف الفرس غلب استعماله في الصريح فإذا قال رها كردم أي سرحتك يقع به الرجعي مع أن أصله كناية أيضا وما ذاك إلا لأنه غلب في عرف الناس استعماله في الطلاق وقد مر أن الصريح ما لم يستعمل إلا في الطلاق من أي لغة كانت (رد المحتار 3/299)
