Value of zakaatable goods

Q: I own a textile mill. I first import the yarn from which the material is manufactured. I supply certain companies material at the manufacturing cost plus ten percent profit. I also wholesale fabric at the wholesale price which is approximately my cost plus twenty percent. I am also a retailer and supply the public at the retail price. When calculating my zakaat, which market am I obligated to take into consideration? Should I evaluate my wealth in accordance to the retailer’s market, wholesaler’s market, or the manufacturer’s market?

A: Since you have purchased the yarn with the intention of trade, zakaat is waajib on it. Zakaat will be paid upon the market value of the yarn at the time when discharging the zakaat. Similarly zakaat is fardh upon the market value of the by-products of the yarn. Market value refers to the price which the consumer (i.e. the public) generally pays to obtain the item, irrespective whether the person was a manufacturer, retailer or wholesaler.

(أو نية التجارة ) في العروض إما صريحا ولا بد من مقارنتها لعقد التجارة كما سيجيء أو دلالة بأن يشتري عينا بعرض التجارة (الدر المختار 2/267)

وذكر محمد فى الرقيات أنه يقوم فى البلد الذى حال الحول على المتاع بما يتعارفه أهل ذلك البلد نقدا فيما بينهم يعني غالب نقد ذلك البلد ولا ينظر الى موضع الشراء ولا الى موضع المالك وقت حولان الحول وروي عن أبي يوسف أنه يقوم بما اشترى به وفى الخلاصة إن كان الثمن من النقود لأنه أبلغ فى معرفة المالية وإلا فبالنقد الغالب وبه قال الشافعى وفى الولوالجية يقوم يوم حال عليها الحول بالغة ما بلغت بعد أن كات قيمتها فى أول الحول مائتين ويزكى مائتى درهم خمسة دراهم (الفتاوى التاتارخانية 165/3)

الزكاة واجبة في عروض التجارة بظاهر قوله تعالى خذ من أمولهم صدقة تطهرهم وتزكيهم بها وصل عليهم إن صلوتك سكن لهم والله سميع عليم واسم المال يتناول عروض التجارة لو خلينا وظاهر الآية لكنا نوجب الزكاة في العروض وإن لم تكن للتجارة لكن ترك العمل بظاهره ههنا إذا لم تكن للتجارة بالإجماع ولا إجماع فيما إذا كان للتجارة فتبقى على ظاهرها (المحيط البرهاني 2/246)
