Which wife should one take for Hajj first?
Q: A man decided to go for haj with his wife but was not accredited to that year. They both got accreditation the following year, however, during the year he got married to a second wife. What are the correct rulings regarding his haj, should he now go without his first wife because he can not afford to take both wives and it will take some time for his second wife to be accredited, or should he take the first wife as planned and make up the time with his second wife on return, or is he now indebted to take the second wife for haj also even though he can not afford to. If the husband and wife go for 6 weeks on the haj journey, should he on return spend six weeks with his second wife.
A: If haj is fardh upon him and his first wife, they should not delay in performing the haj. During the journey, the right of equality between the wives (in spending the night turns) is not taken into account. Hence, the husband is allowed to travel with whichever wife he wishes. Upon returning, the second wife cannot demand compensation of her right during the journey period.
( ولو أقام عند واحدة شهرا في غير سفر ثم خاصمته الأخرى ) في ذلك ( يؤمر بالعدل بينهما في المستقبل وهدر ما مضى وإن أثم به ) لأن القسمة تكون بعد الطلب
قال الشامي : قوله ( وهدر ما مضى ) فليس لها أن تطلب أن يقيم عندها مثل ذلك ط عن الهندية والذي يقتضيه النظر أن يؤمر بالقضاء إذا طلبت لأنه حق آدمي وله قدرة على إيفائه فتح وأجاب في النهر بما ذكره الشارح من التعليل قال الرحمتي ولأنه لا يزيد على النفقة وهي تسقط بالمضي (رد المحتار 3/205)
( ولا قسم في السفر ) دفعا للحرج ( فله السفر بمن شاء منهن والقرعة أحب ) تطييبا لقلوبهن
قال الشامي : قوله ( ولا قسم في السفر الخ ) لأنه لا يتيسر إلا بحملهن معه وفي إلزامه ذلك من الضرر ما لا يخفى نهر ولأنه قد يثق بإحداهما في السفر وبالأخرى في الحضر والقرار في المنزل لحفظ الأمتعة أو لخوف الفتنة أو يمنع من سفر إحداهما كثرة سمنها فتعين من يخاف صحبتها في السفر للسفر لخروج قرعتها إلزام للضرر الشديد وهو مندفع بالنافي للحرج فتح (رد المحتار 3/206)
