Stillborn child

Q: Going through tough times. My wife delivered a stillborn baby boy 2 weeks ago. Please make dua that Allah keeps us both patient. We fully accept and are happy with the decree of Allah, we just feel sad and empty. There was an issue regarding the burial and washing and clothing of our son. I understand that because our son was a stillborn and was born dead no janazah was required. But what about ghusl and shrouding with white cloth, were they obligatory or not. My father asked a maulana and he said to bury him as he is. In the state of grieving I completely overlooked and was not thinking about this issue.

A: A stillborn child will be given ghusl and wrapped in a single piece of cloth and buried. There will be no janaazah namaaz for the child.

والسقط يلف ولا يكفن كالعضو من الميت

قال الشامي : قوله ( والسقط يلف ) أي في خرقة لأنه ليس له حرمة كاملة وكذا من ولد ميتا بدائع قوله ( ولا يكفن ) أي لا يراعى فيه سنة الكفن وهل النفي بمعنى النهي أو بمعنى نفي اللزوم الظاهر الثاني فليتأمل قوله ( كالعضو من الميت ) أي لو وجد طرف من أطراف إنسان أو نصفه مشقوقا طولا أو عرضا يلف في خرقة إلا إذا كان معه الرأس فيكفن كما في البدائع قال وكذا الكافر لو له ذو رحم محرم مسلم يغسله ويكفنه في خرقة لأن التكفين على وجه السنة من باب الكراهة اه (رد المحتار 2/ 204-205)

قال الشامي : والمختار أنه يغسل ويلف في خرقة ولا يصلى عليه كما في المعراج والفتح والخانية والبزازية والظهيرية شرنبلالية (رد المحتار 2/ 228)
