Q: I have been asked this question, and after spending some time some researching conflicting views, I feel it would be best for me to pose this question to you. What is the Shari view on rape within an Islamic marriage? As a student of Islamic Law, how do I respond to a woman who says that she has been raped by her husband?

Taking a second wife

Q: Someone I know was mentioning that a certain man wanted to take a second wife because he says his first wife is not enough to satisfy his physical needs. apparently some women whom he approached for marriage were not too happy when he honestly told them the reason. What I want to know: is this a valid reason? If a persons wife cannot cope with/handle his physical desires- can he take a second wife? Obviously he has to be able to treat her/maintain her at the same level as his first wife. Please give a detailed explanation so it can be passed along to those who object & they would be able to understand clearly.

Q: I have a Brother-in law who is Bi-polar (Mental sickness), He had a re-lapse, whereby he became sick again about a week ago. He is married & has one child. However when he had the re-lapse he pronounced 3 talaaqs to his wife, thereafter he was hospitalised for a week & is now back at home. Is his pronunciation of the 3 talaaqs valid?

Q: My daughter  has been married  for 6 years and separated from her husband 10 months ago. She has been asking for talaq but her husband and his family have been playing delaying tactics. Finally they have agreed  to give her talaq and have asked her to do the following:

  1. Request talaaq by email message 
  2. Return the mehar given to her at the time of nikkah and return gold jewellery given to her at nikah. Will this be classed as khula talaq?

Will it be baain/ complete  talaq?  

She also has gold jewlery given to her by her grand parents at the time of nikah is she entitled to claim this?

What to look for in a boy or girl

Q: By taking into account hadiths and Quran, are there any criterias about the boy to see when the father receives the proposal for his daughter? (such as beauty, wealth etc for example). And what about the criterias in the reversed situation? ie to what should see the boy's parents concerning the girl?
