Reciting the talbiyah after passing the meeqaat

Q: I performed umrah a couple of days ago. I was travelling from Madina to Makkah and I was sure ( i had نیت in my heart) about umrah. At Dhul-Hulaifah I put on two sheets (dress of ehraam) and offered two rakat nafil but I forget to say TALBIYA.

I departed for Makkah after performing nawafil of ehraam and after 5-10 minutes travelling I remembered about talbiya and I said the talbiya and niyat by tongue then and there. Is my umrah correct or do I have to pay any penalty/sadaqah?

A: After making niyyat for entering into ihraam, it is compulsory for one to recite the talbiyah or make some zikr. If one made zikr, the zikr will be a substitute for the talbiyah and one will enter into the state of ihraam. Only when one recites the talbiyah or makes zikr will one enter into the state of ihraam.

If you did not say the talbiyah (nor did you make any zikr) at the time of passing the meeqaat (and you only recited it five or ten minutes later), then you only entered into ihraam five or ten minutes after passing the meeqaat. Hence, you will have to give one damm (goat or sheep to be slaughtered in the precincts of the haram) for the violation of passing the meeqaat without being in the state of ihraam.
