Musjid

Selling the musjid extractor fan to a soup kitchen

Q: During the construction of the Musjid a large extractor fan was put in as a mechanism to assist with cooling. It never worked as expected and was used very few times, and has laid dormant for 5 to 6 years.

Now a soup kitchen (which is a waqf) requires a similar machine. The Musjid wants to give the soup kitchen the extractor at no cost. However, the cost of removing the extractor and patching up aspects of the Musjid where the extractor was attached will be paid for by the soup kitchen.

Please advise if this is correct. If not what should he done as the Musjid wants to get rid of the extractor.

Rules applicable for a place to be regarded as a masjid

Q: I have a few questions regarding masjid.

1. What are the requirements for a building to be called a masjid (and subsequently all the rules of a masjid must be followed)?

2. Do the rules of a masjid apply to a musallah?

3. Can there be a masjid in a non-Muslim country?

3a. I have heard that in Canada a building is not owned permanently by a person and the government can take control of it (either any time or a lease of 99 years apply), so can there be a masjid in the aforementioned case?

4. If one has taken upon an item of the masjid for safekeeping, can they personally use it? It was bought by the masjid money.

Status of a waqf made by a kafir

Q: I request clarification on the ruling of waqf made by a kaafir.

What is the status of a waqf made by a kaafir? For example, if a kafir makes waqf of land for the building of a masjid, is such a waqf valid in Shari‘ah? [Kindly clarify, and also refer to Imdadul Ahkam, where there is mention of a related fatwa regarding this mas'ala].
