Q: I have been asked this question, and after spending some time some researching conflicting views, I feel it would be best for me to pose this question to you. What is the Shari view on rape within an Islamic marriage? As a student of Islamic Law, how do I respond to a woman who says that she has been raped by her husband?
A: There is no such thing like marital rape in Islam. It is wrong for the wife to refuse the husband. The hadeeth is clear about this. If the husband calls the wife and she refuses (without a valid shar`ee reason, like haidh, nifaas, etc.) to share the bed then the malaa’ikah curse such a woman.
طلق بن علي قال : قال رسول الله صلى الله عليه و سلم إذا الرجل دعا زوجته لحاجته فلتأته وإن كانت على التنور (جامع الترمذي رقم 1160)
عن أم سلمة قالت : قال رسول الله صلى الله عليه و سلم أيما امرأة باتت وزوجها عنها راض دخلت الجنة (جامع الترمذي رقم 1161)
