Damm for a person who returned home before discharging the damm

Q: A person got a penalty and he went back to his home country. Later he realized that he has to pay damm/fidya for his mistakes, but what if the person die before giving the penalty? Because he will have to wait to go back to Makkah for damm/fidya.

A: He does not have to wait to return to Makkah Mukarramah. He may appoint someone who is going to Makkah Mukarramah to slaughter a goat or sheep on his behalf in the precincts of the haram as an atonement for his mistake. He should also make a wasiyyat that if he passes away before the damm is carried out, then the damm should be carried out from one third of his estate after his demise.
