Q: I follow the hanafi madhab. I divorced my wife one time and then I went back to her by just uttering the words I take you back as my wife then I divorced her a second time after a few days and then I went back to her by just uttering words I take you back and accept you as my wife. Recently a friend of mine told me that I can't do that. After the second time I must have an imam and witnesses and marry her again the way I first married her. I am worried now. I have already divorced her for the third time now but I am concerned that when I became intimate with her after the second divorce did I fall in sin?
A: After divorcing her the second time, revoking the talaaq is permissible provided she is in her iddat. If you have divorced your wife three times, then the nikaah has terminated. It is not permissible for you both to live together.

الطَّلـقُ مَرَّتانِ فَإِمساكٌ بِمَعروفٍ أَو تَسريحٌ بِإِحسـنٍ وَلا يَحِلُّ لَكُم أَن تَأخُذوا مِمّا ءاتَيتُموهُنَّ شَيـًٔا إِلّا أَن يَخافا أَلّا يُقيما حُدودَ اللَّـهِ فَإِن خِفتُم أَلّا يُقيما حُدودَ اللَّـهِ فَلا جُناحَ عَلَيهِما فيمَا افتَدَت بِهِ تِلكَ حُدودُ اللَّـهِ فَلا تَعتَدوها وَمَن يَتَعَدَّ حُدودَ اللَّـهِ فَأُولـئِكَ هُمُ الظّـلِمونَ ﴿229﴾ فَإِن طَلَّقَها فَلا تَحِلُّ لَهُ مِن بَعدُ حَتّى تَنكِحَ زَوجًا غَيرَهُ فَإِن طَلَّقَها فَلا جُناحَ عَلَيهِما أَن يَتَراجَعا إِن ظَنّا أَن يُقيما حُدودَ اللَّـهِ وَتِلكَ حُدودُ اللَّـهِ يُبَيِّنُها لِقَومٍ يَعلَمونَ ﴿البقرة: 230﴾
