Q:
- Have a sum of money in a Credit Union (CTCL) as savings eg $15,000.00 and receiving divident annually?
- Have a saved sum of $10,000.00 in an insurance company for a term of 5 years. After completion of five years will receive $10,000.00 plus bonus for 5 years?
- Have a sum of money in FNPF (compulsory savings from governments salary for the job we do) and the governments adds some amount to it annually may be as interest/divident or bonus.
- Have a house from which we receive rent as income,which we use to pay the rent of the house we staying in.
- Could zakaat money be given to a person who is on a home loan for the house he is living in.He makes the payment of loan from his salary and also from the rent he receives from a flat attached to his house.
- Could zakaat money be given to a muslim person who married a converted muslim for the payment of the home loan in which they live, as both of them do not follow the muslim culture anymore.
- Is it right (Halaal) or not. I am paying insurance for my ownself from my salary so that if I die due to some reason the sum insured could be given to my kids or life partner so that they do not find difficult financially for some time.Or if I have an accident the money could be given to me so that I can meet my own living expenses when I cannot earn anymore.
A:
- If the dividends (profits) are fixed in proportion to the investment e.g. 10% of the capital investment, it will be impermissible. Similarly, if the investment is of an impermissible nature in Shariah then the dividends (profits) will be impermissible.
- Insurance is impermissible in Islam. Hence, apart from your capital, the remainder wealth has to be given in charity without the intention of receiving any reward.
- The money received through the compulsory savings from government’s salary, together with the bonuses from the side of the government is permissible.
- You do not have to pay zakaat for the house that is given on rent.
- If his debts and liabilities are more than what he owns, he can receive zakaat.
- If they are Muslims (i.e. they have not left the fold of Islam) and their debts and liabilities are more than what they own, they can receive zakaat.
- Insurance is impermissible in Islam.

يَا أَيُّهَا الَّذِينَ آمَنُوا إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ وَالْأَنصَابُ وَالْأَزْلَامُ رِجْسٌ مِّنْ عَمَلِ الشَّيْطَانِ فَاجْتَنِبُوهُ لَعَلَّكُمْ تُفْلِحُونَ ﴿المائدة: ٩٠﴾
( ولا في ثياب البدن ) المحتاج إليها لدفع الحر والبرد ابن ملك ( وأثاث المنزل ودور السكنى ونحوها ) وكذا الكتب وإن لم تكن لأهلها إذا لم تنو للتجارة. (الدر المختار 2/265)
(و لا يجوز الشركة إذا شرط لأحدهما دراهم مسماة من الربح) لأنه شرط يوجب انقطاع الشركة فعساه لا يخرج الا قدر المسمى لأحدهما (هداية 2/632)
( وسببه ) أي سبب افتراضها ( ملك نصاب حولي ) نسبه للحول لحولانه عليه ( تام ) ... ( فارغ عن دين له مطالب من جهة العباد ) ( الدر المختار 2/259)
كتاب الهبة وجه المناسبة ظاهر ( هي ) لغة التفضيل على الغير ولو غير مال وشرعا ( تمليك العين مجانا ) أي بلا عوض (الدر المختار 5/687)
