Q: I had a second marriage recently on 31 Jan. I had no relationship with my wife till now because I got to know that she had not taken proper talaq from her first husband. Talaq is just on a plain paper written by her husband that I give u talaq. There there is no sign of a Qazi or advocate. So now I want to ask u if my marriage is valid or not? Our marriage was done by a Qazi. What should I do now?

Uttering the word divorce without addressing the wife

Q: If a man utters the word "divorce" not for the purpose of his wife's divorce neither was he addressing her at a time when it was uttered. However when it was uttered a thought of his wife came in his mind. Will it constitute divorce ? It was uttered without any purpose. He was not addressing his wife. He had no intention of referring it to his wife. However when it was uttered a thought of his wife occurred in his mind in a flash and disappeared. Now he is worried.

Talaaq issued over the phone

Q: I have been married for 10 years. I had my 1st talaaq when my duaghter was 2 years old. We reconciled soon thereafter and now I have my 2nd talaaq over the phone when my husband moved out for the second time. Is a talaaq valid over the phone?

His reason for moving out is because I am always skelling. He is never home and I am doing everything; seeing to the kids food and the house. Somtimes he comes home very late at night and I am not allowed to even ask where he was. I don't know where he works or how much he earns. Furthermore I don't know where he is currently staying.

He always wants things his way. He wanted a second wife 4 years ago and it never happened. Ever since then things haven't been smooth. I told him that I'm going to MJC and he told me to because that is for people who doesn't know their deen. Ya Allah I love him tremendously. When I asked him today if my talaq is finalized, he said he will call me tonight. When he moved the 1st time he told me he thought the separation would help. I asked him if we cannot mayb have a separation period then a talaaq he said he tried but he tried nothing. I am prepared to make this work, please help.

Issuing a talaaq for legal reasons

Q: My sister got married and after few months her husband ran away to a neighbouring country for some political reason. She was pregnant and got a baby. After two years waiting, he couldn't come back but the only way was she has to follow him. But because she is the wife of that man, the country's law doesn't allow her to leave anywhere unless she is divorced from him so they made an agreement and he sent her a divorce letter. The question is, is their marriage accepted or not?

Suspending talaaq without the intention of talaaq

Q: My wife lives with our kids in our home country in the upper portion of the house while my parents and younger sisiter stay in the lower portion. I live in some other country. There were alot of conflicts between my wife and parents. One day, I asked my wife to stop going downstairs to avoid any further arguments. I threatened her by saying that if she goes down, our relation will be over without any intention of divorcing her. She asked me about going downstairs to use washroom to wash our baby which I allowed her. She went down, washed the baby and use one of the room to change the baby's diaper many times after that. When I went home, she sat many timmes with me downstairs. Things got normal after a few days and my wife made up with my parents. She also started going down to speak to them. However, she did not ask me before going down and I have no problem with that. Is there anything wrong we have done?
