Employee not fulfilling conditions of a contract

Q: A certain person who works at a school decided to leave with a two week notice. The contract states that a three month’s notice period must be given, which is not correct according to the labour law. The labour law states that one month’s notice must be given. However, the board has decided that if the notice period is not served, the employee must pay them three months salary. The current month will not be paid and the employee must pay them for the other two months. Is this condition correct in the light of Shari’ah?

Unable to trace who a payment was received from

Q: I work in the accounts dept of a company. We receive payments into our bank account from customers. Sometimes we receive payments but we cant trace who the money came from. After a few months if no one has come forward to claim the money we give it away in charity. My question is, can I give the money to a fellow employee of the same company who has some loans that they are unable to settle?

Is the answer the same if the employee is owing the loan to the company itself?

Employees starting their own company

Q: My friends and I are planning to register a company which focuses on construction solutions. Presently, we are working in a company as employees and all of us are working in different sectors. Our employer has several businesses, and healthcare is one of them. For each machine installation, they hire a third party for construction and finishing works. My question is that we are the employees of the same company and now we want to open our own company to be the third party for their construction work. Can we take orders for construction jobs from our company without showing them that we own the third company? Will this be permissible?

Q: Mera sawal a hai ke jo log mazdor ku bola ke un se mehnat kara kar mazdori dene ke liye pareshan karte hai un logon ke liye kya kehna cahiye ek mazdor ki mazdori 500 ke hisab se lekar jate hain magar paise dene ke liye bahut pareshan kar rahe hain kuch bhi bolo magar un logon ku thuda bhi haisas nahi hota ke o log mazdor ki mazdori na dene se un mazdoron ke ghar ke halat kaise guzren ge har bar agle hafte dunga agle mahine dunga yahi bath 2 saal se kehte arahe hai magar dene ka irada abhi tak nahi hai aur a ju log hain sare musalman hai ab aap hi bataye mai kya karon mai bahut pareshan hon aur qarz me dobba huwa hon kaam se kam muje e15 se 20 lakh rupye anna hai magar koi de nahi raha hai hamare aqaa rasool allah salalahu alaihi wa sallam ne farmaya hai mazdor ki ujjrat us ka pasina qasq bhone se pahle adda kardo aise logun ku aap kya kahenge?

Reprimanding an employee for passing on wrong information

Q: We have a company and an employee went on vacation. Upon his Return, before coming back to the office, he met another employee who told Him that he has been fired. This was incorrect information and hence the Employee (who returned from vacation) didn't show up to the office yet. We are investigating this further to validate if the second employee did or did not pass on the false message of being fired. If this turns out to be true, what should be our action on it?

Encouraging customers to apply for a credit card

Q: I work in a department store, and as part of the job we are obliged to encourage customers to get a store card, which is a credit card, and if they do, to open accounts for them. I too have to sign their contracts which states they must pay interest if they miss or fail to make their payment on time. What is the ruling on credit cards, and is this work permissible?

Paying one's staff the full salary

Q: I am heading a small stitching and knitting centre where three ladies work. They are all Alhamdulillah purda observant and no male goes there. One of them is on a permanent job. Rest of the two also want their job to be permanent. But the problem is they are overage. They say that they will provide duplicate identity card with less age than actual. That's how the first lady also got permanent. Right now they receive only Rs.5000 and getting permanent means Rs.15000 salary. They are needy and very hard working. They have been working like that for 5-6 years but no increase in wage unless they get permanent. My husband has the authority to give job. I want to ask that will it be appropriate for my husband to give them job while we know that their NIC is a fake one? I really wish to help them but how?

Q: Mein abi tak duty khatam honay se 1 hour ya 1.5 hour pehlay he ghar chala jata tha, kaam khatam ho jata tha to, aisa 2,3 bar he howa ho ga maximum k baad mein kaam aya ho aur wo kaam zruri bhe nai hota tha, dosre din ho jata tha, to meri salary mein kuch haram bhe mix ho gia, ab Allah ka shukar hay mein ne toba kr le aur time per jata houn, to wo maal jis mein haram bhe tha wo kuch meray pass save hay aur mein ne kapray jootay aur sub kuch usi ka abi bhe use kr raha hn, to ab in cheezon ka mein kya krun, jo maal jama hay us ka bhe btaen k wo meray liye jaiz hay ya na jaiz, aur jo kuch mein use kr raha houn kapray ya aur use ki cheezain?

Making the employee pay taxes

Q: An employee works for a company and his stipulation is not set at the beginning. He is paid an amount less than the market rate for such a job. Secondly, the employer places the entire burden of taxes on the employee, whereas the employer is required by law to pay 7.65%. The employee works because he cannot find another job currently, is this Zulm on the part of the employer?

Is it permissible for him to take on clients on the side and complete work in the office and keep the compensation for that? What if he pays for his own supplies such as papers, pens, etc?
